Just look to San Francisco, which has historically been two steps ahead of California when it comes to employment laws. The city has enacted several employment ordinances years prior to California enacting similar state-wide laws. For example, San Francisco’s Paid Sick Leave Ordinance went into effect in February 2007, which was eight years prior to California enacting its paid sick leave law. Employment Law Update: Court Puts to Bed the Issue of a "Day of Rest" On May 8, 2017, the California Supreme Court in Mendoza v. Nordstrom, Inc., No. S224611 clarified the meaning of the day of rest provision in Labor Code Sections 551 and 552. First, the Court ruled that a day of rest is guaranteed for each work week as defined by the employer, instead of on a seven-day rolling basis. Thus, if an employer defines its workweek from a Thursday to a Wednesday, it must prov...ide the employee with one day - any day - off in that workweek. Second, the Court also provided an exception to this rule for part-time employees; the Court found that employees who work six hours or less every day in a workweek can be scheduled to work seven consecutive days. Lastly, the Court ruled that an employer may not cause its employees to go without a day of rest, but employees can voluntarily choose to do so; the employer though is required to apprise employees of their entitlement to a day of rest and thereafter maintain absolute neutrality as to the exercise of that right.
