~~~ NEW LAW ALERT: 1099 v. W2? ~~~ A bill was just approved making it harder to be a 1099. A person should be a W2, not a 1099, unless: (a) The person is free from the control and direction of the hiring entity in connection with the performance of the work. (b) The person performs work that is outside the usual course of the hiring entity’s business. AND (c) The person is customarily engaged in an independently established trade, occupation, or business of the same nature a...s that involved in the work performed. (Some professions are exempt, and the old Borello factors still apply to those.) This law codifies and clarifies the decision in the Dynamex Operations W. Inc. v. In the wake of #metoo solidarity...here's a great case from today that your employer must protect and prevent harassment even when the harasser is NOT a co-worker. M.F. v. Pacific Pearl Hotel Management LLC (CA4/1 D070150 10/26/17) FEHA Sexual Harassment by Nonemployee housekeeping employee stated claims against her hotel employer for violating provisions in the California Fair Employment and Housing Act (FEHA; Gov. Code, 12900 et seq.) requiring the employer to protect the... employee from nonemployee sexual harassment. The Court of Appeal concluded that the following allegations by the employee were bring claims under the FEHA for sex harassment by a nonemployee and for failure to prevent hasrassment: (1) she was raped while working on the employer's premises by a drunk nonemployee trespasser; (2) the employer knew or should have known the trespasser was on the employer's premises for about an hour before the rape occurred; and (3) the employer knew or should have known that, while on the employer's premises, the trespasser had aggressively propositioned at least one other housekeeping employee for sexual favors.
