Our law clerk, Clare Demera, officially completed law school last night! Clare will graduate, with honors, from San Joaquin College of Law on May 29, 2021 and sit for the California Bar Exam on July 27-28, 2021. We are so proud of you Clare! Join us in congratulating Clare on this accomplishment!

During law school, she assisted our family law department as a law clerk and proved to be an invaluable asset to the firm. As an attorney, Zena will focus her practice on family law.

We are so excited to have our law clerk, Marisol Cruz, back at the firm during her Christmas break! Even more exciting is the fact that she just completed her first semester of law school at San Joaquin College of Law!

We have received a number of phone calls seeking information about the Stay-In-Place orders and COVID-19 and whether it affects custody arrangements. Fresno Superior Court recently clarified this exact issue and we would like to provide this information here for quick reference. Because a parent is presumed fit to make the day-to-day parenting decisions to care for the child, they are expected to follow all guidelines set forth by their State and/or local orders regarding ...social distancing. For this reason, COVID-19 is not a reason to deny a parent of their parenting time. If the parents live in different states, it is not recommended the exchanges happen through air travel though the parents can mutually agree to this. Should you have any questions regarding your custody arrangement, relating to COVID-19 or not, feel free to call us at (559) 227-1100.

On April 6, 2020, the Judicial Council of California placed a halt on all evictions, residential or commercial, regardless of cause. The only exceptions are for evictions that are found to be necessary for public health or safety. The effect of this order means that the court cannot issue summons on an Unlawful Detainer action; entry of default cannot be entered for a defendant's failure to appear unless it is to protect public health and safety AND the defendant has not ap...peared in the action within time allowed for by law; if the defendant has appeared in the action and requests a trial, the trial cannot be set earlier than 60 days from the date trial is requested. Further, all foreclosures on mortgages or deeds of trust are stayed and the statute of limitations are tolled. The emergency order will remain in effect until 90 days after Governor Newsom declares an end to the current state of emergency or is amended or repealed. Employers: Are you familiar with the Families First Coronavirus Response Act? Pursuant to this Act, two laws were enacted that provide workers with paid leave for reasons related to the novel COVID-19. PPS has made it a priority to learn of these new laws as they are enacted to ensure we can provide our clients with immediate assistance as to how they will, are, or could be affected by these laws. If you are unsure whether the new laws apply to you as an employer, call us. We can provide you with a detailed overview of the laws, which employers they apply to, and how they operate.

Update re: COVID-19 Fresno has implemented Shelter-In-Place Emergency Order 2020-02. Starting March 19, 2020, the firm will be closed to the general public for any in-person matters. This will not affect our clients ability to contact the firm via telephone or e-mail; nor will this affect our attorneys and support staff from continuing to work on and pursue our client’s legal matters. Though some matters may be affected by closures and/or modified procedures by the courts (i.e. trial dates), we will continue to keep our clients updated with any changes as soon as we learn of them.

As the novel coronavirus (COVID-19) continues to spread, we want to ensure we do our part in keeping our families, staff, clients, and overall community safe from the spread of this virus. The City of Fresno has declared a state of emergency to help fight the virus. At this time, our firm and like businesses are not being affected with mandatory closures, however, we are requesting in-person visits to the firm be reserved for emergencies. Our staff will continue working to en...sure our client's needs are still being met and will be available during regular business hours to answer any questions or concerns you may have. This includes our attorneys who will be available by phone or e-mail as normal.
