NBC News had a very interesting article on the ongoing dispute between the Michael Jackson estate and HBO. The Jackson estate sued HBO for $100 million, stating that the "Leaving Neverland" documentary violated a 27 year old non-disparagement clause that the network signed in 1992 in relation to a Michael Jackson concert film during the "Dangerous" tour. The appeals court found for the estate, which opens the path for the matter to move to arbitration. The estate may or ma...y not win the arbitration, but that's now up to the arbitrator. The 2019 HBO documentary, "Leaving Neverland" accused the late singer of sexually abusing two boys and HBO has argued that the non-disparagement clause from the concert film is irrelevant because the 1992 agreement had expired once each side fulfilled its obligation. The panel of judges stated: "An arbitration clause can still bind the parties, even if the parties fully performed the contract years ago." What do you all think? Do you agree with the judges? Is a handshake deal, a valid deal? Yes it is. A handshake deal is just as enforceable as a giant 100-page contract. Where the problems begin is that, over time, and with nothing to refer back to, people tend to remember details differently, especially if it's in regards to something they are unhappy with or feel is unfavorable to them. One person will say "she said this" and the other person inevitably will say "she said that." ... So, again, to answer the question, a hand shake deal is enforceable but also not recommended! It's been such a crazy year. When Kobe Bryant, his daughter Gianna, and passengers passed away back in January, we still were not aware of the coming COVID-19 pandemic and how much things would change for the rest of the year. Lives have been drastically and irreparably affected Sports has been on the back burner.... The NBA found a safe way to continue the season and bring some normalcy back. Winning an NBA title is extremely difficult to do and in the same year of Kobe's passing the Lakers were able to deliver one. So, congrats to the Lakers and the city of L.A.
