‘FCC Releases Ruling on Park Hill Fiber Decision’ The FCC has reversed a denial of funding ruling to the Park Hill School District in Kansas City. Park Hill School District had requested funding for a self-provisioned fiber network while sharing a portion of the network with non-eligible parties. The District was denied funding because it shared its unused fiber strands with the City of Kansas City. Upon the denial of funding by USAC, Park Hill School District filed an ap...peal with the FCC. The appeal cited multiple precedents, however, the appeal relied in part on a precedent set in the Healthcare Connect Fund Order from 2012. Here is the summary: The agreement between Park Hill and Kansas City is the kind of sharing arrangement permitted under the rules of the FCC. The FCC clarified that the rules do not require E-Rate applicants to exclusively own and use the entire self-provisioned network. The Second E-Rate Order, released in 2014, allowed E-Rate eligible entities to construct their own network or portions of their own network when it is the most cost-effective solution. In making self-provisioned networks eligible for E-Rate support, the FCC pointed to the success of Rural Health Care Pilot program participants that elected to use support for self-construction for parts of their networks, and confirmed that it would follow the model the FCC adopted in the ‘2012 Healthcare Connect Order’ here to ensure that the Fund supports self-construction only when it’s the most cost-effective option. Under the Healthcare Connect program, participants are not required to exclusively own and operate self-constructed networks when they are their facilities with ineligible, for-profit entities that pay their fair share of network costs. The same model applies in the E-Rate context. This clarification comes at a time when districts and public entities are seeking to expand their abilities to serve communities. While this does not create any new rulings or findings, this clarifies that applicants can share the expense of a self-provisioned network with other ‘for-profit’ entities, that pay their ‘fair-share’ of the cost.
