DACA (DREAMERS)/DAPA (Parents of DREAMERS) UPDATE: The Supreme Court yesterday decided that the DACA termination announced by the Trump administration is legally deficient. DACA beneficiaries are (for now) still entitled to seek protection. BLG Prediction: The Trump administration will announce a new, more thorough, revocation of both DACA and DAPA in the next few weeks unless petitions to Congress make immigration reform into a priority for action before the fall elections.... From the decision: "The Fifth Circuit, the highest court to offer a reasoned opinion on DAPA’s legality, found that DAPA violated the INA because it extended eligibility for benefits to a class of unauthorized aliens. But the defining feature of DAPA (and DACA) is DHS’s decision to defer removal, and the Fifth Circuit carefully distinguished that forbearance component from the associated benefits eligibility. Eliminating benefits eligibility while continuing forbearance thus remained squarely within Duke’s discretion. Yet, rather than addressing forbearance in her decision, Duke treated the Attorney General’s conclusion regarding the illegality of benefits as sufficient to rescind both benefits and forbearance, without explanation. That reasoning repeated the error in Motor Vehicle Manufacturers Association of the United States, Inc. v. SMALL BUSINESS UPDATE: Monday April 20 at 1:00 PM Facebook Live I now have confirmation that the first round of PPP loans have been funded. That means that I ...will be able to go live tomorrow to update business owners on how to proceed with their three scenarios: 1) Applied and got the $, what now? 2) Applied but no money, what now? 3) Haven't applied, what now? I will also be delivering preliminary information on the Federal Reserve's Main Street Loan Program, to begin roll out May 1st. Some good news for Ventura County businesses today (after we went live this morning with a challenging update on how to operate in this month of lockdown): 1) many businesses are reporting receiving their emergency Grant funds today by direct deposit. These reports are consistent with the $1,000 per employee throttling that the SBA administratively selected in order to stretch the grant funding from the CARES act farther. Obviously, this means that the only businesses to rec...eive $10,000 will be businesses with 10 or more employees, also likely the businesses that will feel a significant lift from this grant to a lesser degree than those that employ fewer people. Obviously, this funding was not disbursed within 3 days of applications being received, as provided for by the statute, but a bird in the hand is worth two in the bush and this is great news for businesses that were frankly, gasping for the necessary income to stay open. 2) many businesses are also reporting that today their SBA approved lender is issuing loan documents for PPP loans. Once signed and funds are disbursed, this could be great news for employees of small businesses for the next month and a half. It's important for businesses to remember that the proceeds from this loan must be, at least 75%, spent on payroll and that you must maintain your payroll throughout the next two months in order to have the proceeds of the PPP forgiven by the government later. Keep your records and have a very clear eye about how much money you can spend paying your rent, utilities, and other necessary expenses. If it exceeds 25% or if you lay off employees during the next month and a half, the loan proceeds will not be forgiven by your bank. 3) the climate in Ventura is riding to the rescue, because temperatures today are above 70 degrees Fahrenheit and that is virus-killing heat. A heatwave would be a blessing for our community as we continue to work to flatten the curve and restore our ability to maintain good mental and social health. We will do another live briefing later this week with updates as they are responsible to share.

We have had many clients apply (including ourselves) and none have had any approval/rejection or any funding received.

In order to satisfy our County government, and offer limited services as an essential business, the notices on the front door are now up as ordered by April 12th. (Candidly, having all those notices up reminds me of nothing so much as being subject to a eviction and sheriff's auction. But, as a lawyer, I'm not going to encourage anyone to defy the law.)
