Most people choose their children as their trustee. However your child isn't always the best person to choose. The number one reasons families fall apart when the parents die is over money and objects of sentimental value. When choosing your trustee think of a person who has a level head and will be fair and impartial. A trustee's job is to facilitate the decisions you left in your trust, not to make the decisions. You might want to consider a professional trustee. A professional trustee will help keep your wishes intact and may lessen the fighting between siblings.

I hear it all the time "My sister knows what to do if something should happen to me." That is a wonderful thought but unless you have executed the proper legal documents to give your sister the authority, they have none. Your sister will have to go to court to obtain the authority you wanted her to have to take care of you, your health and your finances. This is the same for your spouse. Your spouse has very limited authority unless you legal give it to them, with the proper estate planning documents.

Here are some questions to consider when starting your estate plan. What are my assets and what is their approximate value? Whom do I want to receive those assets and when?... Who should manage those assets if I cannot? Who should be responsible for taking care of my minor children if I become unable to care for them myself? Who should make decisions on my behalf concerning my care and welfare if I become unable to care for myself? What do I want done with my remains after I die and where would I want them buried, scattered or otherwise laid to rest?
