TAX TIME, TAX TIME, TAX TIME You at least get more time this year. April 15th is normal as you know, but Washington DC observes its Emancipation Day on that dat...e so it goes to Monday, April 18th. If you are from Maine or Mass., you know that is Patriot's day so you get until the 19th. Do not have the money: go ahead and file your return or extension anyway because the late filing levy is 5% a month (this is called the Don Cordelone rule). To avoid other penalties when you file the extension, send them some money. You can do it by check, IRS Direct Pay, or use your credit or debit card. Or there is an online payment agreement, and you can set up an installment plan and add more to our national deficit. There is even a penalty abatement program for first time offenders. Do not call. I say do not call that number you hear in radio and TV ads. There are many alerts going out about scams at this time of the year. I got my first call a few days ago. "IRS is filing a law suit against you for this year so please call this number at once." Do not call to complain about the call, you get put on another call more often list. Note for Real Estaters: Guarino, TC Summ. Op. 2016-12: Mr. Guarino, a taxpayer in the business of brokering mortgages received a commission in connection with his purchase of a resident. That is income, pay tax. However, the Court ruled no self-employment tax because it was a personal transaction. For all you future Mr. Guarinos, when you are buying a property as a broker, negotiate a price with the normal commission and when feasible, renegotiate the price down with no commission for you. One step further: When I did syndication investments on apartment houses, I normally took my commission as a 3rd on the property. This was to allow better leverage for the investors, a buffer on payments, and if the property was not successful, I got no money. One time IRS said, "You got a note for this much money." Pay tax. I illustrated to them that just after the close; I went to a FDIC bank and asked them to buy the note. They said that the note was worthless to them at that time as a 3rd on a rental. I showed this to IRS and passed that audit item. I paid tax on the note when I got paid as the property was sold or traded, as the Lord intended.

FORCED ARBITRATION; GOOD OR BAD FOR YOU AND ME A statement from Richard Cordray, director of the Consumer Financial Protection Bureau, indicates that this agenc...y that is designed to protect you and me in financial matters is looking at this question. It’s about time. He says, "By inserting arbitration clause into their contracts, companies can side-step the legal system, avoid big refunds and continue to pursue profitable practices that may violate the law and harm customers." Come on, Richard tell us what you really think. A couple of other phrases; "Companies should not be able to put themselves above the law and avoid public accountability." "Consumers should be able to join together to assert and vindicate their established legal rights." What does the other side say? "Arbitration offers a simpler, fairer and faster way to resolve disputes than going to court." "This bill is about more lawsuits, more money for lawyers, and less justice for consumers." Public Citizen Advocacy Group studied one year of arbitration proceedings. Score: Credit Card Firms -94%, Consumers -6%. Could it be the arbitrators realize that they are selected and paid by the businesses? BTW, California has a law about this subject, but Federal Law is more restrictive, so it rules. Interesting: Remember on the California Residential Purchase Agreement there is a section about Arbitration. As a buyer or seller, you have to answer yes or no. To have Arbitration both parties must agree. No agreement no arbitration. So be ready to make your decision and get advice. On credit card agreements and doctor office agreements, you are in almost all cases agreeing to arbitrate. Next doctor's agreement, I am going to cross it off and see what happens.

Most of the time, It feels like I spend the bulk of my days floundering, wanting to get good things accomplished at work and in my life and usually feeling as i...f I'm doing a poor job of it. But this week something happened which seemed to transcend my inadequacies as a "housing specialist" and for that I'm feeling extremely thankful... A young man who has been staying at Hospitality House was told that he will be able to move into an apartment of his own and for those of us who know him, it feels like a miracle. Several years ago he had been arrested on a DUI, and because he could not give up drinking, he decided to move to another state, breaking his parole and leaving behind his obligations to the court. But while away, in his own words he "hit bottom" and eventually went through an intensive alcohol rehab program sponsored by the Salvation Army that lasted more than a year. Eventually, because his family was still here in Nevada County, he decided to come home, hoping to work through the estrangement from them as well as face his legal problems. He came to Hospitality House with nothing but the clothes on his back. Soon he had secured a full-time job and had started saving money, with the hope it would help lead to housing. He enrolled in our Rapid Rehousing program. After receiving his application and completing a background check, a local property management company said that they would rent to him, but only if his legal problems were cleared. We spoke to the Deputy Public Defender and she said that if our client turned himself in, he would almost certainly face jail time, which meant that he would lose his job and that he would no longer qualify for housing. The rock and a hard place... We put together a letter to the DA, advocating as strongly as we knew how, the sincerity behind our client's sobriety, the fact that he was working hard, saving his money, asking that somehow, some way, he be spared jail time, so that he could be housed. The Deputy Public Defender gave us a sliver of hope. She said the District Attorney wanted to see documentation that our client had actually completed the out-of-state rehab we had described. Salvation Army faxed the proof and we forwarded to the DA. Last Thursday, I met my client at 6:30 am at Utah's Place. We were both nervous, maybe me more than him. He went to the courthouse to self-surrender at 7:00. By 8:30 he was standing in front of a judge. The Deputy Public Defender made our case. The judge looked at the DA and asked...well? The DA said he could see nothing to be gained by demanding jail time. The original sentence was imposed with no additional reparations added. By 10 am we were standing inside the property management company where they were asking our client which unit he wanted, No. 7 or 15? Come Monday, our client moves into his new place, with a fresh start on life. I'm grateful to Hospitality House, I'm grateful for federal grant money that allows us to house the homeless. I admire the immense bravery of a client who chose to pass though the fires of "making things right." It gives hope to all of us and he will forever inspire me.

GOOD NEWS FOR LANDLORDS AND TRUCK MAKERS; The number of prospective young tenants is up. This will keep vacancy rates low over the next five years. With jobs ...coming the boomerangs will be moving out of the parent's basements. Among hot markets: Atlanta, Dallas-Ft. Worth, Phoenix, Houston, and LA. Vacancies are expected to drop to around 4.8% from 8% in 2009. No crystal ball needed to know that this means rents will be going up. Truck sales are the best since 2005. Cars not so much except for the Tesla's electric sedan that is popular with affluent technophiles. Compact crossover SUV's that are built on a car chasis with optional all-wheel drive and the higher profile of a SUV are popular. Favorites are the Jeep Renegade, Mazda CX3, Chevy Trax and the Honda HR-V. Toyota is bringing out a new Tacoma to compete with the Chevy Colorado and GMC Canyon. Nissan's Titan is doing well even with the diesel version. Love the new concepts where the car finds a parking spot and then parks. I want one that analyzes data available and keeps me away from Sig-Alert. See you at the Dealers.
