El DHS ha anunciado una moratoria de 100 días sobre las deportaciones a partir del 22 de enero de 2021. Ha aceptado voluntariamente renunciar a cualquier derecho a permanecer en los Estados Unidos, siempre que se le haya informado plenamente de las consecuencias de la renuncia y se le haya brindado una oportunidad significativa de acceder a un abogado antes de firmar la renuncia; o 4. Para quien el Director Interino de ICE, luego de consultar con el Asesor Jurídico, tome una determinación individualizada de que la ley requiere la remoción. A más tardar el 1 de febrero de 2021, el Director interino de ICE emitirá instrucciones adicionales sobre la implementación de esta pausa a las deportaciones. " Esta nota parece hablar solo de las deportaciones físicas, pero no impide que los jueces ordenen la remoción de alguien. Tampoco se aborda nada sobre los miles de inmigrantes detenidos en esta pandemia. Las condiciones de detención continúan siendo peligrosamente problemáticas y los brotes continúan exponiendo innecesariamente a los detenidos a graves problemas de salud y la muerte. La Directora de Servicios Legales de ImmDef, Yliana Johansen-Méndez intervino: "Detener o retrasar las deportaciones y suspender las nuevas inscripciones en los Protocolos de protección al migrante (MPP) es una medida provisional. Hay una multitud de memorandos y cambios de política implementados por la administración de Trump que están resultando en una denegación enorme de beneficios, que también deben ser rescindidos o reemplazados. A pesar de la moratoria, USCIS puede continuar rechazando solicitudes de asilo, estatus de inmigrante juvenil especial, residencia permanente legal, exenciones y otros beneficios de inmigración".
