Yesterday, May 20, 2021, we began the Article 32 hearing for Sergeant First Class (SFC) Rob Nicoson at Fort Bragg, NC. The Army prosecutors did not call one witness to testify. Instead, the prosecutors are relying on the very thin Army CID investigation and the very low burden to send the allegations to a General Court-martial. Importantly, just prior to the hearing, we were given access to two classified investigations the prosecutors believed they had sent to us. They di...d not. Those investigations were conducted into the allegations against SFC Nicoson well before CID got involved. Those investigations also contained very favorable evidence for SFC Nicoson. We entered both of those investigations into evidence and are asking that the investigations be declassified. While I can’t go into the facts contained within those investigations yet, I think it’s fair to say that SFC Nicoson was not even in the country at the time two of the charges are alleged to have occurred, there is evidence in the investigation that shows SFC Nicoson did not violate the law or intend to commit any wrong, and that SFC Nicoson’s actions were Valorous during the firefight that occurred on August 17, 2020 PicCred - Terminalcwo

To put to rest the speculation and answer the inquiries coming into our office, our client Chief Special Warfare Operator Tony DeDolph, USN, has entered into an agreement with Rear Admiral Charles Rock, USN, to resolve his pending charges. This agreement will end the contested charges, allowing SOC DeDolph to accept responsibility for those offenses he can and mitigate most of the concerns over classified material present in the case. We believe what is intended by a person’...s actions is eminently important and the agreement recognizes that SOC DeDolph never intended to injure SSG Logan Melgar, USA, but also recognizes the fact that SSG Melgar died as a result of actions that went tragically wrong on June 4, 2017. The fact that SSG Melgar’s death was not intentional may not lessen the righteous feelings of grief by family and friends, but perhaps the resolution of this case will further help them find closure and peace. Camp Pendleton Issues Shelter In Place Guidelines - 1:45 p.m., Sunday, April 5, 2020 Marines at Camp Pendleton have been ordered to follow California's "shelter in place" guidelines and face severe penalties if they don't, according to the military base's commanding general.... Brigadier General Daniel Conley on Saturday issued the instructions to Marine Corps Installations West, which includes Camp Pendleton. "As of March 19, the state of California instituted a `shelter in place' order," Conley wrote. "The order directs all individuals to remain at home or place of residence, except as needed in limited circumstances." The commander's order said all personnel will curtail their off-duty activities to abide by the California orders. "Travel while on leave or liberty is only authorized to conduct essential services such as medical needs, groceries, banking, exercise and gas stations," the order said. "While in a leave or liberty status, and while traveling to conduct essential services, all MCIWEST personnel shall limit travel to within a 30-mile radius of their residence." Marines are ordered to have a "heightened awareness regarding the spread of this infectious disease." "Marines and sailors are not authorized to attend social gatherings outside their home, and social contact at private residences will be limited to household members only," the order states. Violations of the order are punishable under the Uniform Code of Military Justice, the commander said, and personnel may be subject to "appropriate administrative or judicial action." Conley is the commanding general of Marine Corps Installations West and the Marine Corps base at Camp Pendleton. While more than 38,000 military family members occupy base housing complexes, Camp Pendleton expands to a daytime population of 70,000 military and civilian personnel.
