Prop 25 is a veto referendum to stop SB10 (bail reform) from becoming law. Want to know how bail reform works? Look no further than New York where it was already tried and failed. In fact, it only lasted 4 months after enactment (Jan thru Apr of 2020) before Governor Cuomo and Mayor Bill de Blasio previous advocates of bail reform had to REVERSE themselves and push a new bill to stop the damage. Only three weeks afte...r New York's bail reform was enacted, CNBC said, In what’s becoming an almost hourly stream of depressing updates, New York’s newspapers, local TV news shows, and news sites are posting story after story about violent crimes being committed by people instantly released after arrests because of bail reform. Making matters worse, some of the repeat offenders have been arrested for committing acts of anti-semitic assault and harassment just as New York is seeing a disturbing spike in those crimes " (Novak, Jake. We've had an experiment with "zero bail" in California during the COVID pandemic. We saw similar bad results suspects get arrested for a crime, are released within hours, and go on to commit the same crime again. . We don’t think the risk assessment algorithm described in SB10 makes California’s effort at bail reform any better. At its core, it is the END to cash bail that will have negative consequences. . TPOA says the concept of addressing financial inequities in the criminal justice system is a valid concern. But PROP 25 is not the answer. PROP 20 will address certain aspects of previously passed criminal sentencing and supervision laws that have had negative consequences for victims and public safety. . Currently under California law, assault with a deadly weapon is classified a "nonviolent" offensealong with date rape, selling children for sex, and 19 other clearly violent crimes This includes domestic violence, exploding a bomb, shooting into a house with the intent to kill or injure people, raping an un...conscious person and beating a child so savagely it could result in coma or death. Sex traffickers typically beat, rape and drug their victims before selling them for sex. But in California, trafficking is a "nonviolent" offense. Even hate crimes are considered "nonviolent." . As a result, thousands of offenders convicted of these and other violent crimes, including sex offenders and child molesters, are eligible for early prison release, WITHOUT serving their full sentences, and WITHOUT their victims being warned. . Proposition 20 fixes this. . Furthermore, "It doesn't send one new person to prison. It simply requires violent offenders and sexual predators to complete their full sentences," says Michele Hanisee, president of the Association of Deputy District Attorneys "Claims that Proposition 20 will fill our prisons with thousands of new inmates are false." In the State of California, people on parole are still considered in custody of the state prison system serving a prison term. A parolee is denied rights afforded under the US Constitution’s 4th amendment (search and seizure) and their freedom is highly circumscribed through rules and regulations that if violated send the parolee right back to prison. . This means parolees are not done serving their prison sentence and debt to society. Parolees get their 4th amendment righ...ts back when they finish parole and that’s when they should be considered for getting their voting rights back. . Based on recent arrests and investigations; we are seeing what is shaping up to be an extensive fleecing of the California Employment Development Department (otherwise known as EDD). This is also being reported by other police departments. . Suspects have been able to register and receive a seemingly never ending supply of Bank of America debit cards from the EDD department. The cards can be used to withdraw up to $1,000 per ATM a day. We have seen the value of the cards seiz...ed range from $5,000 to $20,000. . This has been made possible because EDD suspended many of their checks and balances. This was done in order to provide rapid benefits to those in need. Unfortunately, this created a loop hole that has been exploited. . WHAT CAN YOU DO TO HELP? . One, suspects are generally having the cards sent to addresses that are not their own. They must intercept the mail. You may see unusual loitering and suspicious behavior around mailboxes especially close to mail time. This can be your house, a neighbors house, or a house for sale anywhere mail can be received and there is public access. If you see suspicious behavior call the police and report it. If you find EDD mail and you did not apply for it, call the police. . Two, report suspicious behavior at Bank of America ATM’s. Bank of America is the only bank issuing EDD cards Suspects have been known to stand at an ATM while making multiple cash withdraws using multiple EDD cards. This is unusual. If you see this, call the police. . Three, many people unknowingly are victims. This is important because EDD income is taxable for federal purposes. We would imagine EDD will have to create a notification system to advise victims, but currently that is not in place. Be aware of information provided by EDD regarding the fraud and any victim notification. . Four, if you legitimately need the EDD benefits and your named has been used by a suspect; it will prevent and delay your receipt of benefits. . EDD is now aware of the problem and has started working to address the fraud. However, we anticipate some delay before you will see any significant effects from their actions. .
