Contempt hearings are much like criminal proceedings in that the potential punishment involves time in jail and/or a substantial fine. That applies even when the contempt citation arises out of a non-criminal case. Recently, the Hallinan Law Firm was retained to represent the beneficiary of a trust who, by mistake, received the entirety of the trust's funds and then proceeded to spend all of it before the mistake was known to the court. The court ordered full return of the... funds and cited her for contempt, so she retained the Hallinan Law Firm. Lead Trial Lawyer Neil Hallinan brought the matter to a hearing and forced a discharge of the citation by the judge who issued it. While the judge sought to explain why Neil's argument was wrong, Neil convinced the judge that his own premise was mistaken, such that the judge reversed his own ruling and released our client from his citation of contempt. Rather than languishing in jail while awaiting his hearing two weeks later, Kenneth accepted the misdemeanor offer, and on Friday, December 13, he walked out of jail with no felony conviction. Today the Hallinan Law Firm celebrates a victory. Jesse D. retained us in April, subsequent to his preliminary hearing at which he had been displeased with his representation. He was charged with attempted robbery with the use of a weapon, assault with a deadly weapon causing great bodily injury, and having a prior strike conviction, thus facing a state prison sentence of 19 years and four months. The prior attorney established facts at the preliminary hearing which only s...trengthened the prosecutor’s case against Jesse. Once Jesse hired the Hallinan Law Firm, however, we litigated motions, conducted investigations, and methodically whittled down the case against Jesse such that we were able to negotiate a settlement offer with which our client was extremely happy. Jesse was transported to court this morning, in custody, anticipating that we would begin a difficult jury trial. Instead, he pled No Contest to a misdemeanor and is going home tonight.
