On Tuesday, the Montana Senate unanimously passed a bill that would put a state constitutional amendment on the ballot to elevate the privacy of a person’s electronic communications and data to the same level as persons, houses, papers and possessions. Sen. Kenneth Bogner (R-Miles City) introduced Senate Bill 203 (SB203) on Feb. 9. If approved, the resolution would allow voters to consider an amendment to Article II, section 11 of the Montana State Constitution that would ...require the government to obtain a search warrant in order to access a person’s electronic data or electronic communication. The amendment would add the following highlighted words to Article II Sec. 11 of the state constitution. Searches and seizures. The people shall be secure in their persons, papers, electronic data and communications, homes, and effects from unreasonable searches and seizures. No warrant to search any place, or to seize any person or thing, or to access electronic data or communications shall issue without describing the place to be searched or the person or thing to be seized, or without probable cause, supported by oath or affirmation reduced to writing. If passed by both the Senate and House by a 2/3 vote, the proposed amendment would go before Montana voters in November 2022. Today, Michigan voters easily passed a state constitutional amendment that elevates the privacy of a person’s electronic communications and data to the same level as persons, houses, papers and possessions. The Michigan legislature put Proposal 20-2 on the ballot. It requires any Michigan government agency to obtain a search warrant in order to access a person’s electronic data or electronic communication. The amendment added the following highlighted words to Article I Sec.... 11 of the state constitution. Sec. 11. The person, houses, papers, and possessions, ELECTRONIC DATA, AND ELECTRONIC COMMUNICATIONS of every person shall be secure from unreasonable searches and seizures. No warrant to search any place or to seize any person or things OR TO ACCESS ELECTRONIC DATA OR ELECTRONIC COMMUNICATIONS shall issue without describing them, nor without probable cause, supported by oath or affirmation. The provisions of this section shall not be construed to bar from evidence in any criminal proceeding any narcotic drug, firearm, bomb, explosive or any other dangerous weapon, seized by a peace officer outside the curtilage of any dwelling house in this state. The ballot measure passed 88-12% with 33% reporting at the time of publication. Sen. Jim Runestad (R-White Lake) along with 27 cosponsors, introduced Senate Joint Resolution G (SJRG) back in June 2019, beginning the process of putting the measure before voters. Both houses of the legislature passed the resolution unanimously. The right of individuals to be secure from unreasonable searches and seizures is fundamental and should be clearly addressed in our state’s constitution, Runestead said in a statement when he introduced the measure. Language in SJRG was modeled on Missouri Amendment 9, which passed in with an overwhelming 75 percent of the vote in 2014. Today, voters in New Jersey passed a ballot measure to legalize marijuana by wide margin, despite federal prohibition on the same. Senate Concurrent Resolution 183 (SCR183) was introduced in 2018 by Sen. Nicholas Scutari and six cosponsors. The measure passed the state Senate in a 24-16 vote while the state Assembly voted 49-24 in Dec. 2019. The measure then bypassed the governor and went directly to the ballot in 2020 as Public Question No. 1. Voters today said yes by a wi...de margin. At the time of publication, it was ahead by a tally of 67-33%. The ballot measure legalizes the possession, use and cultivation of marijuana by persons 21 and older, along with the manufacture and retail sales of cannabis products. The Cannabis Regulatory Commission that currently oversees the state’s medical-marijuana program will manage the regulatory scheme. It reads, as follows: Do you approve amending the Constitution to legalize a controlled form of marijuana called ‘cannabis’? Only adults at least 21 years of age could use cannabis. The State commission created to oversee the State’s medical cannabis program would also oversee the new, personal use cannabis market. Cannabis products would be subject to the State sales tax. If authorized by the Legislature, a municipality may pass a local ordinance to charge a local tax on cannabis products. New Jersey legalized medical marijuana in 2010. The program languished under Gov. Chris Christie, a staunch opponent of cannabis. When Gov. Phil Murphy took office, he loosened requirements and expanded the number of qualifying medical conditions.
