May 13 was National Red Thumb Day. The purpose of the campaign is to not only educate people about the dangers of using cell phones while driving, but to actually get them to put their phones away - completely out of sight - while operating a motor vehicle. Although, it is great to have a day dedicated to not using our cell phones while driving, the truth is that every single day should be a "Red Thumb Day." Don't forget, this Sunday, May 3rd, from 8:00 am to 5:00 pm, the biannual Carlsbad Village Faire is taking place in the Carlsbad Village area. In one of my cases, my client was in an auto accident through no fault of her own. As a result of the collision, she was injured and underwent a course of medical care for her injuries. The total cost of her medical care was approximately $13,000.00. The defendant’s insurance had a limit of $15,000.00. Situations like this are frequently quite frustrating. However, with some preplanning, situations like this can be avoided altogether. The above scenario highlights two pr...oblems. First, the at-fault driver simply did not have enough liability coverage to fully compensate my client. Second, my client did not carry any Uninsured/Underinsured Motorist coverage. If the at-fault carried enough insurance, there would not be a problem. However, this is a contingency over which we have no control. We do have control over the amount of insurance we purchase. To protect ourselves from those who carry small liability limits, we simply have to take out as much Uninsured/Underinsured Motorist coverage as we can. Uninsured Motorist coverage provides coverage to us and people in your vehicle who are injured as the result of the negligence of an uninsured motorist. Underinsured Motorist coverage provides us coverage above and beyond the coverage provided by the adverse driver’s policy. In order to make a claim for underinsured motorist benefits, we must first collect the entire policy limits from the adverse driver. We are then entitled to make a claim for the difference between the amount of the adverse driver’s policy and our policy. For example, if the adverse driver had $25,000.00 in Liability coverage and we had $100,000.00 in Underinsured Motorist coverage, then we could make a claim to our carrier for a maximum of $75,000.00. I was recently retained by a motorcyclist involved in a traffic collision (I regularly handle these type of cases). Essentially, the rider was traveling on a well-known street when a car pulled out from a side street to her right and stopped in her path of travel. The driver told the sheriff that he did not see the motorcycle until he pulled out. He also said that once he did see her, he panicked and froze. He left my client with no escape route and she collided with the ca...r. This is a sad but frequent scenario. It brings to light some issues that we as motorcycle riders (myself included) must be aware of. First and foremost, we have to ride as defensively as possible. This means we have to ride with the knowledge that many of the vehicles that share the road with us just plain do not see us!! Second, many drivers don’t know how to react once they do see us. Motorcycles make them nervous (or worse yet, they panic and freeze). Third, we all need to recognize that most of the collisions between motorcyclists and other drivers happen at or in an intersection. Intersections, all types of intersections, are very dangerous places for motorcyclists. We must always use extreme caution when negotiating our way into and through an intersection. However, the truth is that even though we use the highest possible level of skill and care when on our bikes, some accidents, due to the negligence and inattentiveness of other motorists, are unavoidable.
