On January 25, 2021, our Attorneys were at the Long Beach Courthouse to oppose a domestic violence restraining order (DVRO) filed against our client. Our client was in the midst of divorce proceedings when the opposing party filed a restraining order, which alleged years of physical abuse, emotional abuse, and abuse on their child. Since DVROs are typically filed ex parte and are one-sided, our client was not able to respond to the initial application filed by the opposing pa...rty. As a result, the Judge granted a temporary restraining order against our client in November 2020, which prohibited our client from seeing their child. Prior to the January 25, 2021 court hearing, our Attorneys filed a persuasive written response, with exhibits and attachments so that the Judge saw a complete and truthful picture. During the hearing, our Attorneys successfully cross-examined the opposing party to the point where it was clear that the opposing party's credibility was far from reliable. Even before cross-examination was completed, the Judge felt that the opposing party had been dug into a hole that was too deep to be rehabilitated. As such, the Judge denied the restraining order in its entirety. This was particularly important because for several weeks, the restraining order prevented our client from seeing the parties' child. As a result of the Judge ruling in our client's favor, our client was awarded joint legal and joint physical custody of their child! "We have assets that are held in a corporation. How does this affect our divorce case?" When Parties file for divorce, the courts require each Party to fill out financial disclosure forms so that court is aware of what assets exist between the Parties. As a general rule in California, all property acquired during marriage from "community" funds is considered community property. HOWEVER, many of our clients have assets that would normally be owned by the "community"/couple, bu...t are in fact held or acquired by another entity--a trust, corporation, or a limited liability company. This begs the question: Are the assets in the trust, corporation or limited liability company truly separate property of the business entity, or are those assets part of the community? This analysis is fact-driven. Determining if the assets are truly part of the business entity or the community is usually analyzed through the "Alter-Ego Doctrine." If the "Alter-Ego Doctrine" applies then the court will "pierce the corporate veil" and disregard the separate existence of the entity, with the potential to significantly affect the Party that wrongfully withheld the community property. https://local.google.com/place Alcohol abuse and/or the use of controlled substances is a leading factor when a party seeks divorce (dissolution) or legal separation. Unfortunately, this also affects a parental rights as it relates to child custody and child support. In determining child custody, a judge will turn to Family Code section 3011(3)(d): "The habitual or continual illegal use of controlled substances," and "the habitual or continual abuse of alcohol or the habitua...l or continual abuse of prescribed controlled substance by either parent." If the substance is illegal, the court need only consider the "USE." If the substance is legal, the court will look at the "ABUSE." What will the courts consider if one parent alleges use of an illegal substance or the abuse of a legal substance? The court will consider independent corroboration, including but not limited to written reports from law enforcement agencies, courts, probation departments, social welfare agencies, medical facilities, rehabilitation facilities or nonprofit organizations providing drug and alcohol abuse services." If the judge determines that the parent uses or abuses an illegal substance or alcohol, the court may impose certain conditions while that parent is with the child. The judge may also consider testing for drugs or alcohol in determining child custody. Lena Hernandez failed to appear at her Arraignment today. The community and the victim were looking forward to having Hernandez finally answer to her charge of battery. Hernandez’s failure to appear for today’s court date is yet another display of her blatant disregard for the law. As a result of her failure to appear, the judge issued a bench warrant for her arrest and set bail at $20,000. The community and victim demand that law enforcement agencies and the Torrance ...Police Department make every effort to act on the bench warrant, arrest Hernandez, and ensure that the defendant is brought to court to face her allegations. Generally, when a couple legally separates or divorces, the court may order one spouse to pay the other a certain amount of support money each month. This is called spousal support and is also known as alimony. A divorce or legal separation must be filed before spousal support can be legally e...stablished. A spouse can ask the judge to make a spousal support order as part of a divorce, legal separation, or annulment; or a domestic violence restraining order. You can ask for spousal support to be paid while your case is pending and prior to the court's final judgement. This is called a temporary spousal support order. Support can also be ordered once the divorce or legal separation becomes final, as part of the final divorce or separation judgment. When it is ordered once the case becomes final, it is called permanent (or long-term) spousal or partner support. I HAVE AN EXISTING COURT ORDER FOR CHILD SUPPORT, BUT I NEED THAT ORDER CHANGED. You have to show that there has been a change in circumstances since the last child support order was made. There are many good reasons why a child support order might need to be changed. Some of these reasons are: The income of 1 or both parents has changed;... One parent has lost his or her job; One parent has been incarcerated; One parent had another child from another relationship; There have been significant changes in how much time the child in the case spends with each parent; The child's needs may have changed and there may be more (or less) costs for child care, health care, or education; and there have been changes in any of the factors that are used to calculate child support. If the parents can reach an agreement on a new amount of child support, they can enter into a stipulation and give it to the judge for signature and to have it become a new order. But if the parents cannot agree on the change, 1 of the parents must file a motion with the court asking for a change (called a "modification"). Unless the judge signs a new court order, the existing child support amount and order will not be changed. So, to protect yourself, even if you have a verbal agreement with the other parent to change the child support amount, put it in writing and have a judge sign it. That way you have a current child support order that reflects the current amount. (Source: courts.ca.gov)
