When heartbreaking tragic situations like Kobe, his daughter and the other passengers happen, our office phone rings. We are not police officers, firefighters or pastors at Cross City Church. We are not family or friends. We are a local Estate, Probate and Trust Administration law firm. Many of us know the importance of having an Estate Plan, but jumping into action and following through with establishing one is often difficult, as we do not want to think about our morta...lity. I genuinely worry about friends I know do not have a proper Estate Plan in place. Especially those of you who have minor children. Guardians of children are nominated under a last will and testament. If you do not specify your choice, the local court will decide. Without stating your wishes, a probate judge may select an individual who does not share your parenting values or worse, whom you do not like. You may not think your in laws would make a good guardian, but a judge may disagree without proper documents in place. The thought of my boys losing me causes a lump in my throat, but I have sound documents listing the relative I want to raise them based on our religious views, love, stability, knowing he would keep them in the same school, provide ensured safety and lives a lifestyle similar to ours. Additionally, I know my boys guardian will not have to Petition the Court in a public Probate proceeding to receive their inheritance. It will be handled quickly without being held up in Court for a judge to decide, privately, efficiently in a cost effective way. Executing an Estate Plan must be high on your adulting list. Once you complete an Estate Plan and ensure all of your assets are properly titled to the Trust, the good news is you likely do not need to think about the for many years. Having a proper Estate Plan provides peace of mind. When a tragedy hits you will not need to contact our office in a panic.

The neurologist said that dementia/Alzheimer's should be called "failure of the brain," because the other names are nebulous and do not show the severity of the disease to most people. As the patient's brain slowly dies, you know they've changed physically and the caregivers are often in shock. At the last phase, patients will end up bedridden, unable to move, and unable to eat or drink. But it is the different phases beforehand that are just as painful. The day they suddenly... forget how to cook, dress themselves and become confused or combative when you try to fix the shirt or pants they've put on backwards. When they repeatedly ask where their life-long mate is while looking straight at him or her. When they forget their kids and grandchildrens names. When they are confused, angry, or frightened because they are still partially aware of who they were. There will be people who will scroll by this message because dementia/Alzheimer's has not touched them. They don't know what it is to fight or to have a loved one who leads a battle against dementia/Alzheimer's. For all the men and women I know, I ask you a small favor.
