It is not just the "liberal" Ninth Circuit that finds the Trump travel ban unconstitutional. The Fourth circuit is a much more conservative circuit and yet it still finds Trumps ban to be racially motivated. Another reason why it is so important to make sure that we have a change in congress in 2018 so that Trump can't seat any more federal judges who are unqualified!

The "received by" versus "postmarked by" rule is not a statutory provision. It is entirely within USICS's power to accept applications based on the postmark-- as they have previously done with 245(i) applications in 2001. This is just plain cruelty on the part of the government. It is unconscionable.
