Short Sale programs for underwater homeowners are now active. I during the month of Set/Oct, had a client that was never late, had great credit, and we petitioned his lender to sell his proerty in Rancho Cucamonga in a short sale. Our Short sale request was granted and in less than 2 months, His hardshop was that his income had changed significantly, therefore, rendering him in a bind and unable to afford the home. We closed the tansaction. What a blessing for us both. Remember the bill is schedled to sunset on 12/31.12 that lenders will not be able to hold the homeowners repoonsible if the account has a deficit. Need more help, send me a note!

PROTECTING AN EMPLOYEE'S SOCIAL MEDIA An employer is prohibited fro requiring an employee or employment applicant to access personal social media in the employer's presence, to disclose a username, or password for personal social media, or divulge any personal social media. An employer is also prohibited form discharging or disciplining, threatening to discharge or discipline, or retailiatig against an employee or applicant for failing to comply with a request that violates ...these rules. For the purposes of this law, social media is generally defined as an electronic service or account, including websites, blogs, emils, text messanges, photos, videos, and online services. This new doe not prohibit an employer from requiring an employee to disclose a username, passsword, or other access info for an employer-issued electronic device, or to divulge personal social media reasonably believed to be relevant to an investigation of employee misconduct. Requiring 90-Day Notice to Terminate after Foreclosure A month to Month tenant or subtenant in possession of a rental housing uni at the time theh property is foreclosed must be given 0 day written notice to terminate under california law. For a fixed-term residential tenancy, the tenant or sub tenant can generally remain until the end of the lease term, and all rithts and obligations under the leaseshall survive foreclosure, including the tenants obligation to pay rent. Ho...wever, four exceptions allow a 90-day written notice to terminate a fixed term lease after foreclosure as follows: (1) the purchaser or successor-in-interest will occupy the property as a primary residence;(2) the tenant is the borrower or the borrowers child, spouse,or parent; (3) the lease was not the resultof an arms' length transaction, or (4) the lease requires rent that substantially below fair market rent (except if under rent control or government subsidy). Loan Modifications Extending Prohibition Against Advance Fees for Loan Modifications Originally set to expire on January 1, 2013, but now extended, is the prohibition against real estate licensees, attorneys, and others from claiming or collecting compensation for a loan modification or other form of mortgage loan forebearance until after the licensees fully perform each and every service as promised. this law is extended until January 1, 2017 according to SB 980 if not indefinitely according to AB 1950. ANTI-DISCRIMINATION PROTECTION FOR RELIGOOUS GROOMING AND BREASTFEEDING: Effective Jan 1, 2013, the protection against religious discrimination under the california fair employment and Housing Sct has been expressly expanded to require an employer or other covered entity to make reasonable accommodations for an individual's religious grooming or dress practice. Religious grooming or dress is to be construed , and included head, facial, and body hair, nead or face coverings,... religious clothing, jewelwey, artifacts, or other items that are prt of the observance of a religious creed. Segregating an individual is not reasonable aaccommodation of someone's religious grooming or dress practice. No accomodation for religious groooming if it violates civil rights.
