This story is a credit to our San Diego Fire-Rescue Department when a dozen crewmen worked for nearly three hours in the dark to bring Bruno, a 110-pound Mastiff to safety. It can be fun to walk our dogs off-leash. Yet this is just one example of the dangers presented - and the types of legal issues seen by animal law attorneys - when our dogs are not properly leashed.

The Courthouse Dogs Act passed the U.S. Senate by unanimous consent, allowing federal judges to bring trained dogs into courtrooms for emotional support to witnesses. Among other requirements, the dog must be accompanied by a trained handler with knowledge about the legal and criminal justice processes. In 2018, there were 155 courthouse dogs working in 35 statescompared to 41 dogs in 19 states in 2013, according to Courthouse Dogs Foundation. A cat missing for three months ends with the miraculous news that he's found, in time before the wicked cold weather. Milo was found by USDA using a net on airport grounds aided by the highly effective and successful animal tracking service Pure Gold Pet Trackers. On October 3, Milo's human, U.S. Army Captain Molly McFadden, returned from her four-year overseas deployment on a Lufthansa flight from Munich to Washington Dulles International Airport. At baggage claim, she found... a battered crate with no signs of her beloved cat. He was stowed in the plane's cargo hold during flight, and got out sometime between the time he was transported onto the tarmac at Dulles and when his flight kennel arrived in international baggage claim. McFadden said it was "a nightmare I never even considered." She said, Initially, the airline told me they were searching the plane itself since they believed he had escaped during flight however, they said the door was pushed in when they found him gone, and I still don’t think he would’ve yanked the door towards himself to escape. My Labradors have flown in cargo and I've carried Nalu on board going through Dulles countless times. And, I've met baggage handlers who've shared with me horrifying stories of unbelievable things people pack, and the very real difficulties bag handlers face. They work to beat the clock offloading bags to the carousel in record speed. Most bags are overpacked, and cause severe injuries. (I'm known to get the red tag of shame - marked "Heavy"). I'm not defending whoever or however Milo's crate was damaged, and I don't know all the facts. Thankfully Milo was found alive, and hopefully uninjured and healthy. That Milo's kennel was damaged and the locked door pushed in brings to mind images of what poor Milo might have undergone and possible injuries. Milo's experience is an example of the issues brought to animal lawyers. Animal law attorneys help pet owners when their pet has been injured or killed at the hands of another. If your pet is harmed in some way, consult with an experienced animal lawyer in your state to ensure you understand your legal rights and possible remedies.

I can attest to the hard work and success of Babs Fry, she knows what she's doing! If you own pets, make sure they're properly licensed, wear tags and are chipped. Then make sure your registration information is current. The lack of proper identification is one of the main issues in a legal dispute over who has the right to an animal. Animal lawyers can talk for hours about ownership rights.

Bigfoot and Snowball Nolan were the rats we owned as kids. They're a lot of fun, and easy to care for. The San Diego Humane Society has over 100 pet rats up for adoption. The rats have been treated by staff veterinarians and volunteers. They would make a wonderful gift, and are a lot cheaper to feed than a dog!

Last week, HUD announced charges filed against a property owner and manager for violating the Fair Housing Act. HUD claims that the Respondents failed to permit a mother to have an assistance animal for her son (who has a mental disability). Additionally, HUD argues the owner and manager retaliated against the renters for exercising their fair housing rights. I frequently consult with property owners on requests for emotional assistance or psychiatric service dogs. HUD comes ...down hard on discrimination by housing providers, and likewise, any acts in retaliation against residents who raise fair housing concerns or file housing discrimination complaints. California and Federal laws provide that filing a discrimination complaint is protected activity and the government will take action where the facts establish property owners and managers are interfering. Further, housing providers cannot use breed or weight restrictions for assistance animals, even if a local ordinance states otherwise. If you are a property owner or manager faced with such a request, you may want to discuss it with an experienced animal law attorney like myself.
