I hear this TOO FREQUENTLY: "We always thought everything would go to the surviving spouse!!" Married couples with living trusts: PLEASE have your trust reviewed if it's more than 5 years old. Why? Because it's likely that the estate tax avoidance planning that it contains IS NO LONGER NEEDED and will unnecessarily restrict the surviving spouse's use and enjoyment of the decedent's property!... I offer a complimentary consultation and so do many other estate planners. Take the time to address this while you're both alive so you don't have to go to court after one of you dies.
