How Does Depreciation Affect Child Support in California Divorce Cases? California requires its courts to calculate child support in divorce cases by looking at the number of children the couple have; the percentage of time each parent has responsibility for the children; and the income of each parent. With computerization, the task seems pretty easy. https://divorcesd.com/how-does-depreciation-affect-child-s/... The Law Offices of Andy Cook remains open during this national emergency. California Justice Removed From Bench for Sexual Harassment In a first, the California Commission on Judicial Performance has removed an appeals court justice, citing a history of sexual harassment involving multiple victims. Justice Jeffrey Johnson becomes the first appellate judge in California history to be removed from the bench, although he can appeal the decision to the California Supreme Court. https://divorcesd.com/california-justice-removed-from-ben/... California Family Law Judge Punished for Remarks Made on Bench Who judges the judges? In California, that’s a complicated question. If you think your family law judge made a mistake that hurt your case, you may appeal to the Court of Appeal. Most California judges are aware that regardless of what they decide, they must treat parties, witnesses, and lawyers courteously. Arguably, in family law, this is more difficult, because judges hear lots of cases and the acrimony can be ...much worse than in other cases. https://divorcesd.com/california-family-law-judge-punished- The Law Offices of Andy Cook remains open during this national emergency. The Third Time is the Charm Two wrongs don’t make a right, but at least in a recent California domestic violence case, three appeals justices saw it differently. Usually in domestic violence cases, a judge is not allowed to issue a restraining order against both sides by not saying who is at fault and simply declaring that everyone should behave. Rather, a restraining order, which can last up to five years, can only be issued in favor of both sides if each party files a for...mal written request for a restraining order. Even then, the court must make detailed findings of fact that both parties acted as a primary aggressor and that neither party acted primarily in self-defense. https://divorcesd.com/the-third-time-is-the-charm/ The Law Offices of Andy Cook remains open during this national emergency. Another California Domestic Violence Case Mishandled The other day I wrote about a California domestic violence case where the judge made the responding party prove the allegations against her were not true and found that posting a nasty, private Facebook review was enough to impose a two-year restraining order. Not surprisingly, the judge was reversed. https://divorcesd.com/another-california-domestic-violence/... The Law Offices of Andy Cook remains open during this national emergency.
