2019 Updates in Real Estate Law The new calendar year brings several changes in the real estate and landlord tenant landscape. This list is not exhaustive and other changes could be on the horizon. Tenants have more time to pay overdue rent and to respond to an eviction lawsuit. ... Assembly Bill 2343, which becomes effective September 1, 2019, provides three court days to comply with the terms of a lease or to pay unpaid rent, and five court days to respond to an unlawful detainer action. The law amends Sections 1161 and 1167 of the California Code of Civil Procedure and no longer counts weekends and holidays. Price Gouging Protections Extended. California Governor Jerry Brown extended a program that seeks to protect renters by banning price gouging. Under state law, a rent increase may not exceed 10 percent during a declared state of emergency. AB 1919 authorizes penalties against owners who impose a rent increase over 10 percent during a declared state of emergency in violation of the anti-price gouging statute. The order is currently set to remain in effect until May 31, 2019. Tenants may pay rent through a third party, provided that the third party acknowledges that a tenancy is not created with the third party. AB 2219 requires a landlord or landlord's agent to accept a rent payment tendered by a third party so long as the third party provides to the landlord a signed acknowledgment stating they are not currently a tenant of the premises for which the rent payment is being made and that acceptance of the rent payment does not create a new tenancy with the third party. San Francisco Right To Counsel Program is ramping up in 2019. With the passage of Proposition F last fall, San Francisco became the first city in California to require legal counsel for tenants facing evictions and the second in the nation behind New York. The City will be required to provide an attorney to residential tenants through all stages of the eviction process until the eviction notice or unlawful detainer complaint is withdrawn, the case is dismissed, or a judgment in the matter is entered. The legal representation will be full scope and available to a tenant within thirty days after the tenant is served with a termination of tenancy notice or upon the service of an unlawful detainer complaint, whichever occurs first. Funding for this program has been designated and it is expected to move forward with full implementation planned for July 2019.
