Loyola Law School’s Project for the Innocent Client Makes History On October 2, 2019, International Wrongful Conviction Day, California Governor Gavin Newsom signed Assembly Bill 701 into law, making California the first state in America to provide housing services for exonerees upon their release from prison. The bill was sponsored by Obie Anthony, Loyola Project for the Innocent's first client, who was exonerated and found innocent in 2011, after serving 17 years of a sente...nce of life without the possibility of parole. Since his release, Obie has created and is Executive Director of Exonerated Nation, a nonprofit that provides a range of services to exonerees upon their release. "Words cannot capture the severe emotional, psychological and financial challenges exonerees face when the prison gates finally open and we are free again. We are expected to somehow find a way to survive after being wrongfully imprisoned and never knowing if we will see the outside world again. Having immediate access to housing is absolutely critical as we transition to our long-awaited freedom," says Obie. Thanks to my hero, Professor Laurie Levenson, for amazing accomplishments! LANDLORDS, HOUSING PROVIDERS & MANAGEMENT COMPANIES: refusing to rent to male students while you rent to females is not only wrong and unfair, but it is a violation of California and federal Fair Housing laws. More specifically, it is discrimination on the basis of gender/sex. With the housing crisis facing Californians, there is absolutely no room for discrimination on any basis. Besides, the penalties can be steep. No qualms about this.

CALIFORNIA MINIMUM WAGE: Although there are some exceptions, almost all employees in California must be paid the minimum wage as required by state law. Effective January 1, 2018, California’s minimum wage became $11.00 for employers with 26 or more employees and $10.50 for employers with 25 or fewer employees. These amounts will increase to $12 & $11 respectively come January 1, 2019. Is your rental unit infested with bed bugs, roaches, and/or other vermin? Is your landlord/management company dragging their feet about eradicating these pesky, unhealthy creatures? Controlling bed bugs and roaches can be uniquely challenging; these pests seem to have become resistant to insecticidal control measures. The California legislature has codified this infestation and vermin issue into the Civil Code ("CC"). So, CC section 1942.5 forbids a landlord from increasing ...rent amounts, reducing services or otherwise retaliating against a tenant who notifies the landlord or complains to an appropriate agency about a suspected infestation. The CC contains additional safeguards that protect tenants. Landlords are cautioned to follow the law. Recently and here in Los Angeles County, several tenants filed suit against a large apartment complex that had been infested with bedbugs for years. The jury awarded the sum of $3.5M! As we commemorate and remember the great Dr. Martin luther King, Jr. who was born on January 15, 1929, died on April 4, 1968, and strove for equality, it’s important to note that effective January 1, 2018, the recently signed Assembly Bill 168 (AB168) makes it illegal for California employers to ask job applicants about their prior salary. Moreover, under this new law, if an applicant asks, a California employer, no matter its size, must give the applicant a pay range for the... job she/he is seeking. The goal of AB168 is to narrow the gender wage gap. If a woman is paid less than a man doing the same job and a new employer bases her pay on her prior salary, gender discrimination can be perpetuated. AB168 goes further by prohibiting employers, orally or in writing, personally or through an agent, from asking about an applicant’s previous pay. However, if the applicant voluntarily and without prompting provides this information, the employer may use it in determining the salary for that applicant. A violation of the restrictions set forth in AB168 (Employers, Salary Restrictions) is a misdemeanor.
