So many of us live in wildfire prone areas. Those of us that do know what fire season is like. A question that has come up a lot in my office lately is what do we do with our estate planning documents. Here at my office I do not normally keep and store original documents except in certain circumstances. I do have hard copies and digital copies stored in two different secure fire and flood proof locations. But where should you store your original Will and Trust especially in ...fire and flood prone areas? I always suggest a fire and flood proof safe. These can be purchased in various sizes and various prices but make sure it can withstand high fire heat for an extended time. There is also the possibility of a safe deposit box. Many banks have very reasonably priced safe deposit boxes. However, be careful with the name on the box. Make sure the box is under the name of the Trust or has a joint owner. States have different requirements as to when and how a person can access a safety deposit box after a person dies. Nevada County and California friends: Just an update to let you know that the Law Office of Kim White is still open. Most legal services are deemed essential in California. While I am working mostly remotely I am still available to execute Estate Planning documents such as Wills,Trusts, Amendments, Power of Attorneys and Advanced Healthcare Directives. In addition, I am available for consultations regarding contract issues and several other areas of law impacted by COVID-19 a...nd the "Stay at Home Order". There are currently only two of us working on my floor at the office and only a handful in the entire building so social distancing is practiced with ease. I also have secured a mobile notary who will come to the office to notarize documents when needed. She is able to use a separate area down the hall from my office so again social distancing is exercised at all times in an out of my personal office on the third floor. I ask that you please make an appointment rather that just stopping in as we are taking extra precautions and limiting appointments on my floor so we are able to keep us and clients safe.
