Another full not guilty verdict. After a small accident, client blew a .11 BAC and was arrested for DUI and child endangerment. After pointing out how CHP failed to do a proper investigation failed to follow their own policies and procedures, jury returned verdicts of NOT GUILTY on all counts. Even though there were only 2 trials this year, due to the pandemic, it is another perfect year of wins in jury trials.

Congratulations to a strong client on a full victory at trial. Wrongfully charged and accused of 3 felony counts of assualt with a deadly weapon (strikes) 1 count felony vandalism 1 count of hit and run. Was facing significant custody time and strikes. Congratulations to strong client that refused to take any deals and received a full NOT GUILTY verdict after a 4 day jury trial. Client was arrested for 2nd offense DUI after a minor collison. Client was suffering from sleep walking after Ambien was found in his system and the jury concluded, after only 30 minutes of deliberation, that he was unconscious, therefore he was NOT GUILTY. If you act while unconscious, you cannot form intent, mens rea, therefore you are not guilty for your actions. Also, thank you Dr. Adam Kaye from UOP for explaining to the jury that this reallly does exist and some made up thing.

New trial victory. Client charged with 5 felonies: 1. 1st degree burglary, with person present 2. Criminal threats 3. Vandalism 4. Possesion of brass knuckles... 5. Felon in possesion of tear gas. Prior stike conviction enhancement. With all allegations and enhancements, looking at atleast 25 years, rejected 4 year offer day of trial. Verdict....NOT GUILTY, on everything except misdemeanor vandalism and possesion of knuckles. Fyi....i told the jury to convict on those. Took jury 30 minutes to come back. Another win, good start to 2019
