Risk Management Question: What precautions can you take to avoid pandemic-related cyber scams? The Issue: As the number of you are adopting social distancing and working from home increases, so do the related cyber risks. Hackers have well-rehearsed playbooks that seek to exploit distributed work forces using remote connections. As a result, you should be extra vigilant and take additional precautions.... Among other scams, hackers are circulating phony but legitimate looking: *COVID-19 outbreak maps. *Emails purportedly from IT teams to employees with the subject line: "ALL STAFF CORONAVIRUS AWARENESS." The emails describe a seminar at which the company will discuss what it's doing in response to COVID-19, which includes a link to register for the seminar. *Emails claiming to be from vendors about COVID-19 tools and strategies that include links to PDFs and Word Documents and invite the recipient to click and open the attachment. *SMShing messages closely resembling the employer's phone number, indicating the recipient needs to "click here" to find out about modified firm operations. These seemingly harmless and legitimate looking emails and attachments are loaded with malware which deploy remote access tools (RAT), keystroke logging malware, desktop image capturing malware, and ransomware. Hackers are looking to potentially gain control of your remote access into your system or encrypt computers and anything else the malware can reach. Risk Management Solutions: Here are several steps you can take to protect yourself: 1) Always think before you click. 2) Never click on an email or text message from anyone you don't know. 3) If you receive an attachment in an email or text message you were not expecting--even if it's from someone you know--call the person at a known telephone number (not the number listed in the message) to confirm the message is legitimate. 4) If you click on something you should have avoided and a box opens that asks you for your password, or to supply some information or click on a link to enable a later version of software: stop, close out, and immediately call your IT department to have a scan run on your device(s). 5) Remember the ongoing risk of public Wi-Fi. If you can connect to Wi-Fi without a password, then the network is insecure. Do not use insecure Wi-Fi to connect to your work server, do any personal banking, or send any type of confidential or personal information. 6) Avoid working in public spaces where third parties can view screens or printed documents. DUI BLOOD TEST'S, NOT ALWAYS ACCURATE. KNOW THE FACTS Most people believe that if a DUI blood test returns results that are unfavorable to the DUI suspect, there is nothing that can be done to contest this evidence. This is untrue. There are several ways that a good DUI lawyer can challenge the results of a positive blood test due to the high possibilities of DUI tests becoming compromised during the blood draw process. If the attorney can prove that the integrity of the test... was not maintained from collection of the sample to analysis to the final report, then the results cannot be used to convict the suspect of driving under the influence of alcohol. Error of sample collection is a common issue. If a blood sample is not taken the correct way, it could become contaminated and skew the final results. In fact, studies have revealed that incorrect blood draws leads to a false positive result in up to 50% of blood draws. Why is the error level so high? Although the drawing of blood is a delicate medical procedure, it is most often performed by someone with limited medical training in DUI cases. Errors in collections many times come from inexperienced or improperly trained personnel. One common example is when suspects are swabbed with ethyl alcohol, rather than a non-alcohol based product, before a sample is taken the very substance the test is designed to detect! Another common reason for false positives involves the way in which a blood sample is stored and maintained prior to and during testing. Improper storage can cause a blood sample to ferment inside of its container due to the presence of sugar, bacteria, and yeast all of which are natural substances to have in the body. Furthermore, if a blood sample is not properly treated with anticoagulants and preservatives, the sample could clot or otherwise become unfit for testing. Changes in temperature or delays in storing the sample can make it even more likely for alcohol to form inside of a blood vial, leading to an inaccurate measure of exactly how much alcohol was present in the suspect’s veins at the time they were driving. With your freedom and future at stake, you should absolutely contact an experienced DUI attorney who can help you challenge the results of your blood test. Just because your test returned evidence of a BAC of .08 or more does not mean that you don’t have a legal defense!
