WE DIDN'T GET THE FULL TRUTH FROM THE CITY AND THE LAKESIDE HOA ABOUT THE CULVER CITY SMOKING BAN For some reason, the Culver City brouchure and Lakeside Village HOA memo that was recently distributed to everyone's door didn't tell the truth, the whole truth, and nothing but the truth. We hardly get any information individually delivered to us from our Association anymore, and it woujld be nice to see more candor when we do. There was no mention in those materials left at ...our doors about the use of e-cigarettes or vaporizers, which are not, repeat NOT, prohibited by the new rules and ordinances that are addressed in the distribution. New Section 9.11.205 of the Culver City Municipal Code contains numerous definitions applicable to the smoking ban that goes into effect in the city on May 26, 2016. One of those definitions included is for the noun smoke, as follows: The term SMOKE includes, but is not limited to, tobacco smoke and marijuana smoke, but specifically excludes vapors from electronic smoking devices. (Capitalization in original ordinance.) You can find the entire ordinance at http://library.amlegal.com/nxt/gateway.dll (Highlight, copy and past that web address into your browser, then navigate to Chapter 11 of Title 9 in the Municipal Code.) So, whether or not the Board acts in good faith and with good judgment to establish designated outdoor smoking areas on the premises, that still does not mean that the consumption of tobacco and marijuana are banned on the common area grounds, in our private condos, or on our individual balconies, so long as vaporizers are used. Why the folks from the City and the HOA wouldn't tell anyone this is hard to fathom, unless one suspects that they have agendas that don't fail to include complete honesty and candor.

WHERE DID ALL THE MONEY GO? Anyone who is familiar with this site will recall that I sued the Association when it wouldn't follow the law and divulge requested financial records. The court not only agreed that the documents were wrongfully withheld by the association, but also ordered the association to pay me $1,500 for its violations of the law.Apparently Pres. Roz hasn't learned this lesson. She doesn't seem to understand or care that she must manage the homeowners' mone...y as a trustee of all those funds, that is, on behalf of the homeowners and not just any old way she sees fit. Also, as a part of her legal, ethical, and moral duties in this regard, she must be sure that the association accounts for how the approximately $2.5 million is taken in and expended by the association each year. Remarkably, Pres. Roz has not managed the association to meet its specific legal obligations to distribute to each and every homeowner an outside audit of last year's Lakeside revenue and expenditures. This audit, by law, was due last week to all the homeowners. No one has seen neither hide nor hair of it.This maladministration by Pres Roz, after several years in office now, is truly disturbing. It is clear that if Lakeside can not meet this important legal deadline to account to the homeowners how their money has been spent, then there can be no realistic expectation that the $2.5 million it received last year was spent with any modicum of frugality and integrity. This violation of the homeowners' legal rights to an accounting occurs after Pres. Roz spun Lakeside's management around in circles with all kinds of shell games last year, outsourcing then reversing course to in-source our employees, and also putting bookkeeping into the hands of an outside property management firm (or at least from the board's minutes at one point she appeared to). And there is already talk in the board's minutes, barely a year after raising monthly dues, to impose a special assessment on the homeowners! Can you spell "W-A-S-T-E"? How about "I-N-C-O-M-P-E-T-E-N-C-E"? See more
