After much anticipation we received the Final Order today regarding DACA. The Judge concluded that the memo cancelling DACA was invalid. The Judge ordered that within 3 days the CIS must display on its website and on the websites of all relevant agencies, that IT IS ACCEPTING FIRST-TIME requests for consideration of deferred action under DACA, renewal requests, and advance parole requests, based on the terms of the DACA program prior to September 5, 2017 memo, and in accord...ance with the Court's decision of November 14, 2020. Also, the notice must clarify that work permits that were granted for only one year are automatically extended to two years. Last year, we took a vacation to Armenia, travelled to many parts of the country and made a special trip to Stepanakert. I was simply amazed at all its beauty and serenity! I met the wonderful and friendly people living there. Everyone was SO kind and SO hospitable. I could not imagine that Artsakh was at war years earlier. Stepanakert was bustling and absolutley beautiful! It is devastating to see and hear how the people of Artsakh are now suffering. I truly believe that the people of Artsakh deserve their land, it is rightfully theirs. We all must speak up and do whatever is in our power to make sure that the international community does not remain indifferent to the tragedy that is happening in Artsakh. To all my friends, I ask you to please read about what is happening in Artsakh and talk and share about the situation there. Together we will make a difference for us and for our proud Armenian children. And, if you are able, please make a donation to help the people. On September 29, 2020, the U.S. District Court for the Northern District of California, issued an order temporarily prohibiting DHS from implementing or enforcing the new fee increases. DHS was very unhappy with the order, but it issued an update stating that while the 2020 Fee Rule is enjoined, it will continue to accept USCIS forms with the current editions and current fees. A U.S. District Judge has ordered the State Department to expeditiously work in sending out the 45,000 diversity visas (DV) that were put on hold due the Presidential proclamations before the visa period expires on Sept. 30. Sadly, even with this order, many DV winners will be left out since they have to overcome a complicated web of COVID related hurdles and may not get to a consulate in time to secure their visas. First, a small victory. There was a lawsuit filed to force USCIS to produce work permit cards. USCIS had been approving the applications for work permit, but had not been sending the physical cards. Finally, parties filed a lawsuit, and the Court agreed that USCIS must produce the cards in a timely manner and send them to applicants. The lawsuit also forced the USCIS to post a note on USCIS site that the approval letter should suffice as permission to work until the cards are produced and sent out. AILA and several other advocacy organizations have filed a lawsuit challenging the final rule that drastically increases the cost of applying for immigration benefits, including naturalization and asylum. The lawsuit claims that the increase in fees is arbitrary and unreasonable to low income immigrants forcing them to give up valuable rights simply due to lack of funds.
