Too Many Traffic Tickets = License Suspension Most of us are all too familiar with the good ol’, yet dreaded, traffic ticket. They have happened to just about all of us at some point or another, all it takes is one day of running late or not paying attention and BAAAM, speeding ticket, stop sign ticketetc. Then we get all pissed off with thoughts of hundreds of dollars in fines and increased insurance rates all while thinking doesn’t that cop have anything else better to ...do? If you get too many tickets in a given period of time the DMV can suspend your license under their Negligent Operator program. In CA the DMV can suspend your license for 6 months, YES 6 months, if you get the following: 4 tickets in 12 months 6 tickets in 24 months 8 tickets in 36 months However, all is not loss, before the DMV can suspend your license you’re entitled to a hearing on the matter and you’re given an opportunity to fight for your license. However, you have to pay attention to the fine print and schedule the hearing within 15 days of receiving the letter or else DMV will deem your silence as agreement to the suspension. A gambling person can take it upon themselves to argue their own case but I will caution you, the person at DMV is a professional and has heard every excuse and b.s. story in the world probably 100 times over. Odds are, it won’t be pretty at the end of the hearing. A wise person will hire their own professional to help even up the score. A well-trained attorney, such as Justin P. Barrell, will not only help you prepare for the hearing, but be part of the hearing to ensure that everything pertinent to your case is discussed so that a fair and accurate decision can be made regarding your privilege to drive. Just like anything else, the DMV only considers specific things on whether they will suspend or not. Having a professional on your side that knows the key things to say during the hearing can make the difference between a 6 months suspension OR being placed on probation with your driver’s license still intact. Charged w/DUI: Do I Really Need an Attorney? Ever since I became a Criminal Defense Attorney a lot of people have asked me: Justin, tell me honestly, do I really need an attorney if I get a DUI??? My answer is: It depends.... Why does it depend? It depends because it boils down to how much you trust your government and all of those involved in the law enforcement field and the judicial system. Here’s something to think about: The Police: their job is to make a good arrest, the more good arrests they make the more likely they are to promote and make more money do you really think they’re going to write a report favorable for you OR one supporting a good arrest? (if the arrest report was good for you, there would be no arrest) The District Attorney: their job is to prosecute you, the more prosecutions they put under their belt, the more likely they are to promote and make more money and keep their job. As a matter of fact, in a court of law, the prosecutor is your adversary (i.e. your opponent or enemy to put it bluntly). What do you think the odds are that they are going to throw out your case if something very little (that you don’t know about) in that awesome looking police report doesn’t look right?very unlikely, remember, their job is to prosecute you! Without an attorney it’s a take it or leave it deal if you choose to represent yourself in court. The District Attorney will make you an offer to resolve your case based upon all the wonderful things the police officer wrote about you in the arrest report. At that point you have to trust your opponent that they are being fair with you in a very high-pressure situation. I’ve seen people take horrible deals simply because they don’t know any better and think their opponent (i.e. the DA) is being fair. The truth is, can an attorney guarantee a better result each and every time, not at all. But what is guaranteed by hiring an attorney is peace of mind. No matter what the outcome is, you have a highly trained professional on your side scrutinizing every aspect of the case to make sure you’re being treated fairly. You have someone on your side to tell you what’s fair and what’s not. Whether it be myself or another attorney, it’s always good to consult with a professional because a simple first offense DUI is a misdemeanor crime and carries up to 6 months in county jail, not too mention it’s a permanent criminal conviction on your public record. To Expunge or Not to Expunge That is the Question? For anyone who has ever had a lapse in judgment in the past (i.e. did something stupid, was arrested and convicted of a crime) and would like to close the door on that past mistake, the law provides relief under California Penal Code 1203.4, also known as an Expungement. Under the code, misdemeanors and certain felonies can be expunged from your criminal record, although they DO NOT magically disappear (nothing can do that)..., the past conviction(s) are dismissed after the fact. The most common crimes the average person is arrested for are DUI, Petty Theft, Drunk in Public, Disturbing the Peace (i.e. fighting), things that many of us may have done in our younger days. What Does Dismissed After the Fact Mean? It means is that you have successfully paid your debt to society and you have done all that you can do to show everyone that you have taken all steps possible to put that past mistake behind you. Having an expungement granted by the court allows you to legally answer NO to any misdemeanor convictions on most job applications and background checks (not withstanding certain circumstances). For most people, this is vital in today’s competitive job market, the last thing you will ever want is a past mistake from your younger days to come back and haunt you and keep you from getting that job you always wanted. Can I Do an Expungement Myself? Absolutely! 3 Easy Way to Avoid Being Arrested for a DUI this Weekend. 1.) Don't drink and drive!haha Okay that was a bit of a joke since it's a no brainer - in all seriousness, the next three tips are aimed at people who may have had a drink or two and feel completely okay to drive after a sufficient amount of time but end up getting arrested for a DUI because of their own actions. In no way am I advocating drinking and driving under any circumstances but after working hundreds of case...s, believe me, people end up getting arrested all the time for being under a 0.08 and they could have easily avoided it by not doing some of the following: 1.) Don't Speed - period! Time and time again, people get pulled over for speeding in the middle of the night - this is probably the NUMBER 1 reason for people under a .08 to get stopped. My advice - use Cruise Control - set it and forget it. Set it 3 mph less than the posted the speed limit and avoid such a silly reason for getting stopped. 2.) Put away the Cell Phone - don't talk, text, surf Pandora, don't even look at your phone - leave it in your pocket, purse or glove box until you get home. 3.) Vehicle Equipment Violations - You'd be surprised how many people get stopped for a cracked windshield, no front license plate, illegally tinted front windows, burned out head/tail/license plate light(s). Make sure all of these things are up to code or working. Don't give the cops a reason to stop you, because trust me, they will use any reason possible to do a DUI investigation. Avoid these 3 simple mistakes and you can avoid paying me thousands of dollars to help get you out of a bind. I've represented numerous people arrested for having a BAC of .05 to .07 - as much as I'm a business man, I'd rather you not get arrested. ****Note: always use a designated drive and never drink and drive.

Saved a client's driver's license today in Placer County Traffic Court! He was cited for doing 100+mph and risked a 30-60 day court license suspension. I worked my magic in the court and the client only had to pay a fine, the client was super happy! A person prior to my client's case faced a similar situation with no attorney and got hit with a 30 days suspension and a $2K fine!
