Judge brings back DACA in Full Force. Big December surprise for Trump and his minions when a Judge struck down all restrictions placed on DACA by his Administration. This is great news for a lot of people who have been in the U.S. for a long time and for those who have already received DACA benefits because: 1. New DACA applications will be accepted.... 2. DACA renewal applications will be valid for a period of two years, once more. 3. Applications for Advance Parole will be accepted, again. This means that DACA recipients who want to travel to their home country to visit an ill or aging relatives may do so with the knowledge that they will be admitted back into the U.S. and, in the future, they would be eligible to apply for adjustment of status. Once more we have these "adult" leaders of ours unable to reach an agreement on a DACA law and President Trump tying a knot between DACA and the Wall to make sure that it does not pass without someone giving in to Trump. Until there is another seesaw everyone who is eligible to apply for DACA benefits should do so immediately. Do not hesitate as Trump may try to come up with some other made-up reason as to why DACA should end. Get your status protected even if it is temporarily. Get your Employment Authorization Card. Nov. 10, 2017 The Trump Administration has made it clear that it is going to enforce the law on all immigrants but exempt itself from the rule of law. The recent announcement to cease TPS for Nicaraguans by January 5, 2019 and the delay in making a decision for Hondurenos for six months are such an example. As with DACA recipients, it is now up to Congress to act compassionately but will they? Everyone who is here on TPS should look into whether they can change their status b...ased on family relationships with U.S. born immediate relatives or some other means because waiting for Congress to act in a positive way is being too wishful. The problem is not in ending TPS but it is in sending mixed messages to people for years and years, leading them to believe that their status under TPS will continue forever or at least, until Congress fixes their status. September 5, 2017---- DACA UPDATE! President Trump has broken his word! After saying he would protect Dreamers, President Trump announced today he would wind down DACA. ... What this means is that Congress has a six month window to pass new legislation to address this issue. As of now, no new DACA applications will be processed. DACA recipients with a permit set to expire before March 5, 2018 will have the opportunity to apply for a two-year renewal. DREAMERS, the dream is still alive. Two senators, one Republican and on Democrat (Lindsey Graham and Dick Durbin) have introduced a bill in the Senate that would allow Dreamers a path to becoming Lawful Permanent Residents and eventually apply for U.S. citizenship. In General, those individuals who entered the U.S. when they were young, graduated High School or obtained a GED Certificate, have worked lawfully or attended college for at least 3 years, or have served in the mil...itary, and have passed a background check will be eligible to become U.S. residents under this proposed law. What makes this bill exciting is that it is proposed by members of the two parties and shows that there is a concern to address the needs of the Dreamers by doing away with uncertainty of their status under the Trump Administration. May 4, 2016 The Immigration Service (USCIS) has announced that it intends to increase filing fees by as much as 21%. This is astounding as filing fees are already too high. For example, an application for naturalization (citizenship) costs $680 while an application for adjustment of status (residency) is $1490 and can be as high as $2490 under some circumstances. Many government agencies are unable to control their budgets and look for a solution by charging higher fees, in o...ther words taxing people even more. In state courts, the filing fee is $435.00 for an unlimited jurisdiction case and after filing you have motion fees, court reporter fees, and interpreter fees, to name a few, and then have to put up with some unpleasant government employees. There are fee waiver applications that may be helpful to many people who live under the poverty guideline but for most people they are stuck with paying high fling fees. The legal community has been trying to gauge how each Justice will arrive at his or her decision. Issues of Presidential powers vs. State powers are in the forefront but for most people, it misses the point. We have people in our community who work side by side with us, who are present everywhere, who are needed to make our local businesses operate, and who contribu...te in many ways to our communities by paying taxes for example, but who remain marginalized. Do we want to continue to ignore reality or do we want to incorporate them into our society? That is the issue and certainly it is a political issue but too hot for our politicians to handle. DACA & DAPA - 2016 Our Supreme Court announced that it will accept for a hearing the Texas case that placed on hold President Obama's Executive Orders as they related to the following groups: Parents of U.S. citizen or permanent resident children, who have been continuously present since 1/1/10, and were illegal by 11/20/14, who pass background checks and pay taxes, and present no other factors that in the exercise of discretion, makes the grant of deferred action inappropriate. A decision should be made by June of this year and could potentially open the door for millions of people who live and work in our country but remain in the shadows for fear of deportation. Until Congress passes a comprehensive Immigration Reform, having protected status and employment authorization should be welcomed by all.

2015 Year End. The U.S. Government reported that over 462,000 people have been removed (deported) or returned from the U.S. The majority of these people either entered the U.S. unlawfully or remained in the U.S. unlawfully. Over 400,000 people were intercepted at the border and countless others have been denied visas. The situation will not change in 2016 as it is an election year and there is no political pressure to enact a comprehensive immigration reform bill. What to do...? For those people who are in the U.S. look into any program available through the immigration system (USCIS) whether it is DACA for the youth, TPS for qualified individuals, temporary employment petitions, immediate family petitions, or any other petition that will allow you to remain in the U.S. Keep in mind that there is a penalty for overstaying your visa or for maintaining an unlawful presence of 6 months or more. In most circumstances the penalty is that you will not be able to get your residency visa or any other type of visa for a period of 3 years if you over stayed less than one year, and 10 years if you overstayed more than one year. Unlawful presence in the U.S. has negative consequences unless a person falls under one of the exceptions: 245i law, immediate relative classification, or waiver. An important point to keep in mind for those people who are applying for a visa is your stated intent on coming to the U.S. If you are visiting the U.S. on a tourist visa then your cannot state that you are coming to buy a business because your visa will be denied or you will be denied entrance upon arrival, as an example. This is a common problem that occurs at the time of the visa interview. Another issue that arises is limited finances. If you state that you want to visit the U.S. for six months but only have $2000 in your pocket then the Consular Officer may assume that your intention is to work in the U.S. Overall, USCIS has been receptive in dealing with most applications (L-1 visas, E-2 visas, EB-5 visas) as well as family petitions, and have looked for ways to accommodate people. The key is to provide supporting documents to prove your case. This is your burden. See more
