USCIS has updated fee waiver requirements. USCIS has published a new version of Form I-912, Request for Fee Waiver. The new version has removed the use of means-tested public benefits as a factor. According to USCIS, the change was warranted because eligibility requirements for public benefits vary so much state-to-state. Under the new criteria, individuals can request a fee waiver if their annual household income is at or below 150% of the Federal Poverty Guidelines or if they demonstrate financial hardship. Health Insurance Requirement In a statement dated October 4, President Trump put announced a Presidential Proclamation on the Suspension of Entry of Immigrants Who Will Financially Burden the United States Healthcare System. The Proclamation provides as follows:... (a) The entry into the United States as immigrants of aliens who will financially burden the United States healthcare system is hereby suspended and limited subject to section 2 of this proclamation. Attorney General Barr has issued two new decisions on deportation. The attorney general announced two new immigration decisions under his certification power on Friday. The first decision established that two or more DUI convictions automatically disqualify an immigrant from having good moral character. Critics of this decision pointed out that the ruling does not take into account whether the conviction is a felony or misdemeanor, and when the conviction was received. The second decision decreases states’ ability to modify low-level crimes to avoid triggering immigration consequences. Visas: Ineligibility Based on Public Charge Grounds On October 11, 2019, the Department published an interim final rule that amends 22 CFR 40.41, Ineligibility Based on Public Charge Grounds, to add certain definitions, including definitions of public charge, public benefit, alien's household, and receipt of public benefit. Visa applicants are not requested to take any additional steps at this time and should attend their visa interviews as scheduled. The Department is seeking approval for use of a new form before it implements any changes to our processes. We will inform applicants of any changes to current visa application procedures.

Did you know that spouses (and children) of permanent residents (F2A visa category) can now apply for their adjustment of status?
