Tax and Real Estate partner, Michael Wiener, provided input to CQ regarding tax breaks for residential property owners that were included in the coronavirus relief package last month. The fix in last month’s spending package allows certain owners of apartments built or bought before Jan. 1, 2018, to depreciate their investments over 30 years instead of 40 years. Tax partner, Michael Wiener, was quoted in Law360 regarding tax provisions in the Consolidated Appropriations Act and the CARES Act. Tax professionals are uncertain about conformity with provisions in the original CARES Act regarding PPP loans. The Consolidated Appropriations Act clarified that expenses paid for with money from PPP loans created under the CARES Act would be deductible for federal income tax purposes. However, in the original CARES Act passed in March, it was ...only clear that the loan income itself would be excluded from federal taxable income. The point of the CARES Act and the follow-up supplemental appropriations law is that individuals and businesses are struggling, and this is one way to help.
