I-9, Employment Eligibility Verification Form I-9, Employment Eligibility Verification is the form used by the Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE), Homeland Security Investigations (HSI), to prevent unlawful aliens from working in the United States. HSI is tasked with conducting an administrative audit to verify all businesses hire and retain only those employees authorized to work in the United States. HSI has conducted over 5,2...00 I-9 audits in 2018, an increase nearly 400% over 2017. In 2017, HSI penalized $7.8 million dollars in civil fines. In 2019, it is estimated HSI will conduct over 6,000 I-9 audits. The penalties for not completing or having missing information on Form I-9 is $230 per employee or with serious violation, $2,292 per employee. Even with only 10 employees, a business can be fined for up to $22,920 if the Form I-9 is not completed correctly. Worse still, the audit may not end in an administrative fine, but also a criminal investigation regarding hiring illegal aliens. An employer may face criminal prosecution. The goal of an I-9 inspection is to get all businesses to hire only the lawful, authorized workers: U.S. citizens, permanent residents, and employees with work authorization cards. There are variety of reasons why a business may be audited for I-9 inspection. Some of the common reasons are disgruntled employee reporting or apprehended illegal aliens providing information on where they worked. One of the many routes to keeping a business in compliance with the federal law regarding hiring only eligible employees is ICE Mutual Agreement between Government and Employers (IMAGE). This program is a formal membership certification program that focuses on immigration compliance on a voluntary basis. Another route is to train human resource (HR) department on completing and storing the I-9 forms which over-burdens the HR staff. Further, a business can hire a consulting firm, such as Genesis, and streamline the I-9 process to keep compliant with the federal law. The simple 2-page form can be completed and stored for verification when there is an audit, but the complexities arise when the potential employee has a working visa such as H-1B, H-2A, L-1, E-2, F-1, M-1, and or J-1. Our firm reduces the stress of complying with government regulation and has a 100% guarantee if an audit results in any penalties. Remember, State and local employment laws deal extensively with unpaid wage claims, minimum wage, overtime issues, and worker safety. However, Federal laws exclusively deals with I-9 compliance.
