Happy Friday! Week 23 of FREESTATE Fridays goes over the Constitution’s Limitations on basic rights and liberties clause: Restrictions must also be accompanied by adequate remedies. Such temporary encroachments on basic rights and liberties that are compatible with California's mission, goals, and international human rights obligations and that are deemed necessary in the case of an armed attack against California or in the event of other situations of emergency which pose a ...serious threat to the nation may be provided by Act or by Decree to be issued on the basis of authorization given by Act for a special reason and subject to a precisely circumscribed scope of application. There are times in which a right needs to be restrained for the greater good, for example, requiring automotive drivers’ licenses or wearing masks during a pandemic. Article 2, Section 14 limits these restraints to what preserves the overall portfolio of rights most effectively. It also sets a high bar for the authorities to overcome in order to encroach on the rights of an individual. Coupling this with the other protections of Article 2 preserves freedom and liberty from government intrusion while guaranteeing the preservation of a just society. @thefreerepublicofcalifornia #thefreerepublicofcalifornia #FREESTATEatESMoA

Artist Cole Sternberg's solo exhibition FREESTATE, which virtually opened on October 8, 2020 and, for the first time, will be open for in-person viewing through September 18, 2021. This exhibition is one component of Sternberg’s ongoing project The Free Republic of California, a conceptual, agitprop artistic movement. Wide-reaching in its applicationsincluding its own political documents, clothing, and artistic manifestationsthis exhibition encompasses sculpture, text, poli...tical signage, and photography to convey the fundamental core of the project through the lens of visual art. The works serve as a theoretical and artistic gesture for a more enlightened nation through the guise of Californian secession, exploring issues such as human rights, ecological collapse, democracy, and freedom. This exhibition is curated by Dr. Bernhard Zünkeler. https://www.youtube.com/watch?v=bI19IXchH98

Recorded on Wednesday, October 1, 2020, remotely in Los Angeles, CA and Hamburg, DE, this conversation with Artist Cole Sternberg, ESMoA Scholar Álvaro D. Márquez, and ESMoA Curator Dr. Bernhard Zuenkeler explores the provocative and fantastical installation of FREESTATE presented by Artist Cole Sternberg that includes an in-gallery Experience, dedicated website, and propaganda factory that conjures into conceptual existence The Free Republic of California. FREESTATE prolific...ally details and addresses concepts of human rights, the environment, and democracy through a multi-media and publicly activated artistic journey, one that recalls Joseph Beuys’ 7000 Oaks (which precipitated the founding of Germany’s Green Party in 1980). Cole Sternberg employs sculpture in its three-dimensional totality: physical, performative, and social to turn a mirror onto American society’s past moral choices and previously unconsidered future. This week’s FREESTATE Friday goes over the Constitution’s General Clause: The Free Republic of California (‘California’) is a sovereign republic. The Constitution of California (‘Constitution’) shall guarantee the inviolability of human dignity and the freedom and rights of the individual and promote justice in society. The Constitution is a living document, insofar as it should adapt in implementation with the progression of society and technology towards a more enlightened... community. Directly proclaiming that the Constitution is a living document is critical in order for it to organically grow unburdened by constructionist or textualist theories of judicial interpretation. @thefreerepublicofcalifornia #thefreerepublicofcalifornia #FREESTATEatESMoA

Open Call for Curators working in Performance: "The Emerging Curator Program is designed to discover curatorial talent in Los Angeles and provides opportunities for emerging curators to partner with Los Angeles Contemporary Exhibitions. For the program’s seventh installment one project will be selected for presentation in spring 2022. This year, the program is accepting curatorial proposals centered on performance, rather than exhibition. Emerging Curators are encouraged to ...propose projects that can function as a live performance as well as be presented virtually. Proposals may be geared toward a single performance or a series of performances (keeping budget in mind.) Note: this call is specifically for curators and not artists submitting performance proposals of their own work." The artist and floral designer of the altar For Our Siblings, Mario Sandoval, shared a story about the influence and significance of Día de los Muertos in his life: "We are going to prepare the altar," my grandmother Lupe said with great joy. Cempasúchil, that sun-colored flower, they will know how to look for the light back." I can't forget that very indescribable aroma that you could smell them from far away. The scent of home. Moles, breads, fresh fruits, sweets, an in...finity of food that made you want to enjoy it. "Don't even think about it!" My grandmother screamed. "That food is for your grandfather Felix who will come to visit us tonight." About Mario: Mario Sandoval was born in Zacatecas, Mexico, and is one of 12 brothers and sisters. He has worked with flowers since he was five years old thanks to their Abuelita Lupe. Mario loves to read and write and is currently working on a biography of their family. Mario has been a florist at Natural Simplicity in El Segundo for 13 years and a resident of Silver Lake for over 20 years. When he's not working, Mario enjoys cooking and watching foreign films. #diadelosmuertos #altar #mexicantradition

This week for FREESTATE Friday we are going over the Constitution’s Voting Clause: If a constitution is ‘by the people’ and ‘for the people’ should it not strive for the peoples’ literacy and participation? This clause is a rarity in constitutional language, in that it demands governmental proactivity towards the goal of a literate and voting populous. This language specifically articulates manners in which to dramatically improve accessibility for eligible voters. The hope ...is for the act of voting to be inclusive, positive and easy, not a burden on individuals. If you’re a citizen or permanent resident, former criminal or preschool teacher, everyone that has a personal and physical stake in the community deserves the right to vote. This clause ends with a distinct commitment to said universal suffrage. @thefreerepublicofcalifornia #thefreerepublicofcalifornia #FREESTATEatESMoA #vote2020

This week for FREESTATE Friday we are going over the Constitution’s Environment Clause: Protection of the environment, nature and biodiversity is a basic human right and is the responsibility of all government officials, agencies and the populous itself. To that end, California shall be carbon neutral and fossil fuel independent within ten years of the ratification of this Constitution. Additional protectionary measures shall be determined by Act. No nation in the world has... set forth this kind of environmental goal, but it is achievable and necessary. It is time to treat climate change as a world war, a five-alarm fire, a weapon of mass destruction. It is the greatest threat humankind has faced and there is no time left to placate deniers. The earth is also not flat. By specifically including this language in the Constitution, it leaves the government with no choice but to comply. This clause is supported by a significant budgetary commitment in The Free Republic of California, Year One, General Budget Overview. @thefreerepublicofcalifornia #thefreerepublicofcalifornia #FREESTATEatESMoA #sustainability
