Today marks the 45th anniversary of the signing of the historic California Agricultural Labor Relations Act of 1975. California passed this legislation in response to successful organizing efforts to improve conditions for farmworkers borne out of multiple worker strikes and protests that resulted in violence against workers. Prior to the Act’s passage, farmworkers had no legal protection against retaliation for taking collective action to improve their working conditions. T...he National Labor Relations Act, passed in 1935, specifically exempts agricultural workers from its protections to this day, and most states have no laws to address this gap. The Agricultural Labor Relations Act’s goal is to ensure peace in the agricultural fields by guaranteeing justice for all agricultural workers and stability in labor relations. The Act, found in the California Labor Code, explicitly encourages and protects the right of agricultural employees to full freedom of association, self-organization, and designation of representatives of their own choosing, to negotiate the terms and conditions of their employment, and to be free from the interference, restraint, or coercion of employers of labor, or their agents, in the designation of such representatives or in the self-organization or in other concerted activities for the purpose of collective bargaining or other mutual aid or protection. These rights are as important as ever, as agricultural employees have continued to work throughout this pandemic to provide us with food. On this anniversary date of California’s recognition and valuing of this essential workforce, let us pause and express gratitude and support for the nearly one million people who work in agriculture throughout our state.
