How much does it cost to appeal an Immigration Court’s Order to the Board of Immigration Appeals? $110 (as of January 21, 2021 at 5 p.m.). On January 19, 2021, the longtime $110 fee was scheduled to rise to a staggering $975. However, the same day the new fee was slated to go into effect, a Federal Judge temporarily paused the fee increase keeping the fee at $110.... Yes. As of October 2, 2020, USCIS issued policy guidance on this issue. The USCIS Policy Manual to addresses the inadmissibility based on membership in or affiliation with the Communist Party or any other totalitarian party. It states that membership in or affiliation with the ...Communist Party or any other totalitarian party is inconsistent and incompatible with the Naturalization Oath of Allegiance to the United States of America because the oath includes pledging to support and defend the Constitution and laws of the United States. This new policy manual section provides applicants guidance on how to adjudicate inadmissibility due to membership in the Communist Party or any other totalitarian party in the context of adjustment of status applications. Further, according to USCIS the inadmissibility ground for membership in or affiliation with the Communist or any other totalitarian party is part of a broader set of laws passed by Congress to address security and safety threats to the United States. Generally, unless otherwise exempt, any immigrant who is or has been a member of or affiliated with the Communist or any other totalitarian party (or subdivision or affiliate), domestic or foreign, is inadmissible to the United States. It is important to understand that this ground of inadmissibility only applies to aliens seeking immigrant status, for example aliens inside the United States applying to adjust status to that of a lawful permanent resident.
