Case filed by us on our client's (creditor) behalf in O.C. Superior Court to collect on a $120,000 matured loan. Defendant, a citizen of the Russian Federation, living in OC, removes the case to U.S. District Court and immediately files a motion to compel arbitration in Moscow (convenient)! Motion was granted. Our Moscow local counsel tried to open an arbitration matter over there but the Moscow court declined to accept jurisdiction on technical grounds. SO - we go back to U.S. District Court and file a motion seeking an order appointing AAA as arbitrator here in Southern California. MOTION GRANTED! Case will be decided locally, much to defendant's dismay and frustration.
