Congrats to my client M.O. He was arrested for DUI and the DMV ordered a 1 year suspension for an alleged chemical test refusal. We filed a writ with the superior court and it was GRANTED. The judge overturned the DMV because there was no probable cause for the arrest AND there was no refusal. Clients DUI charges will be dismissed and no license suspension. Judge also ordered DMV to pay for our costs.
