I had this question come in to my website (averypi.com): Question: Can you please tell me what authority Evergreen College Campus Police have? ... Years ago they pulled me over and gave me a ticket for running a stop sign on campus. Can they do that? Answer: The short answer is, "yes"! Community College Police derive their authority from section 830.32 of the California Penal Code and section 72330 of the California Education Code. They are police officers throughout the state of California and have the same authority as local police on or near the campus. They can also enforce the law away from the campus, anywhere in the state, if the offense poses an immediate danger to persons or property. 1. Section 830.32 if the California Penal Code The following persons are peace officers whose authority extends to any place in the state for the purpose of performing their primary duty or when making an arrest pursuant to Section 836 as to any public offense with respect to which there is immediate danger to person or property, or of the escape of the perpetrator of that offense, or pursuant to Section 8597 or 8598 of the Government Code. Those peace officers may carry firearms only if authorized and under terms and conditions specified by their employing agency. (a) Members of a California Community College police department appointed pursuant to Section 72330 of the Education Code, if the primary duty of the police officer is the enforcement of the law as prescribed in Section 72330 of the Education Code. 2. Section 72330 of the California Education Code 72330. (a) The governing board of a community college district may establish a community college police department under the supervision of a community college chief of police and, in accordance with Chapter 4 (commencing with Section 88000) of Part 51, may employ personnel as necessary to enforce the law on or near the campus of the community college and on or near other grounds or properties owned, operated, controlled, or administered by the community college or by the state acting on behalf of the community college. Each campus of a multicampus community college district may designate a chief of police. (b) The governing board of a community college district that establishes a community college police department under subdivision (a) may also establish a police reserve officer program to supplement that police department. (c) Persons employed and compensated as members of a community college police department, when so appointed and duly sworn, are peace officers as defined in Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2 of the Penal Code. On Monday, October 25, 1999, Officer Casey responded on his day off to work with mechanics to check and make repairs to Air 1. Ground checks were done and every...thing appeared normal. Officer Casey and the mechanic took off and did a number of system checks while hovering off the ground at Reid Hillview Airport. All systems appeared to be functioning normally. It was decided to bring Air 1 back to San Jose Airport for further tests and maintenance. En route to San Jose Airport, Officer Casey was on final approach when Air 1 went unexpectedly out of control. Officer Casey’s final actions were clear. He struggled heroically with the controls and guided the helicopter to a location where no one on the ground would be injured. As a result, he was unable to slow the decent of Air 1, and it was badly crushed when it hit the ground. Officer Casey and the mechanic where killed on impact. The newspaper wrote, The helicopter slammed into the middle of the street at about 3:30 PM, just north of Interstate 880, barely skirting cars, buildings, trees and power lines. Mayor Ron Gonzales and Police Chief William Lansdowne called the veteran pilot a hero for steering the copter to the only empty spot in the congested area. Chief Lansdowne later received a letter from a local mother whose daughter was driving near the exact location where the accident happened. She thanked Officer Casey’s family for their son’s bravery and self-sacrifice in sparing injury to her daughter and everyone else nearby. Officer Casey was the tenth San Jose Police Officer killed in the line of duty.
