DHS Issues Notice of Proposed Rulemaking for DACA The U.S. Department of Homeland Security (DHS) today announced a notice of proposed rulemaking (NPRM) that would preserve and fortify the Deferred Action for Childhood Arrivals (DACA) policy. If finalized as proposed, this NPRM would codify the existing DACA policy with a few limited changes, including:... (1) Modifying the existing filing process and fees for DACA by making the request for employment authorization on Form I-765, Application for Employment Authorization, optional and charging a fee of $85 for Form I-821D, Consideration of Deferred Action for Childhood Arrivals; the current cumulative fees for both a DACA request and optional employment authorization would remain $495, absent any separate fee increase for the Form I-765 generally; (2) Providing clarity in procedures for termination of DACA and employment authorization, including when DHS will provide an opportunity for the DACA recipient to respond before a DHS decision; (3) Providing clarity to DHS’s longstanding information sharing and use policy for information provided by DACA requestors; and (4) Reiterating our long-standing policy that a noncitizen who has been granted deferred action is considered lawfully present for certain public benefits and does not accrue unlawful presence for purposes of section 212(a)(9) of the Immigration and Nationality Act.

DHS to Continue Temporary Protected Status for Certain Beneficiaries The Department of Homeland Security today published a Federal Register notice (FRN) announcing that it is automatically extending the validity of TPS-related documentation for beneficiaries under the Temporary Protected Status (TPS) designations for El Salvador, Haiti, Honduras, Nepal, Nicaragua, and Sudan through Dec. 31, 2022.... DHS is ensuring its continued compliance with the preliminary injunction orders of the U.S. District Court for the Northern District of California in Ramos et al. v. Nielsen et al., No. 18-cv-01554 (N.D. Cal. Oct. 3, 2018), and the U.S. District Court for the Eastern District of New York in Saget et al. v. Trump et al., No. 18-cv-1599 (E.D.N.Y. April 11, 2019), and with the order of the U.S. District Court for the Northern District of California to stay proceedings in Bhattarai v. Nielsen, No. 19-cv-00731 (N.D. Cal. March 12, 2019). Beneficiaries under the TPS designations for El Salvador, Honduras, Nepal, Nicaragua, and Sudan will retain their TPS while the preliminary injunction in Ramos and the Bhattarai order remain in effect, provided that their TPS is not withdrawn because of individual ineligibility. Beneficiaries under the TPS designation for Haiti will retain their TPS while either of the preliminary injunctions in Ramos or Saget remains in effect, provided that their TPS is not withdrawn because of individual ineligibility. Beneficiaries of TPS for Haiti whose status is continued by this FRN are strongly encouraged to apply for TPS under the new designation of Haiti to ensure their TPS continues should the courts end their injunctions. Beneficiaries may show their automatically extended Employment Authorization Documents (EADs) to employers to demonstrate they have employment authorization and may also show this FRN, which explains that DHS has automatically extended their TPS-related documentation through Dec. 31, 2022. Beneficiaries who would like an EAD with the extended validity date of Dec. 31, 2022, displayed on the EAD, must file Form I-765, Application for Employment Authorization, with the appropriate filing fee (or obtain a fee waiver). Applicants may request a fee waiver by completing Form I-912, Request for Fee Waiver, and submitting it with Form I-765. The FRN also addresses automatic extension of Forms I-94 and I-797 and possible future actions. Designation of Haiti for TPS The Department of Homeland Security today posted for public inspection a Federal Register notice (FRN) newly designating Haiti for Temporary Protected Status (TPS) for 18 months, effective Aug. 3, 2021, through Feb. 3, 2023. The designation of Haiti for TPS allows approximately 55,000 current beneficiaries covered under the Ramos and Saget preliminary injunctions to newly apply for TPS under this designation and retain TPS through Feb. 3, 2023, if they are otherwise eligible.

DACA update It has been a great week since the DACA program was fully reinstated. Many applications for first time DREAMERS were sent out nationwide. But we wanted to provide this update to say that this decision is up for yet another rollercoaster in the next weeks. Texas and several other states are urging a federal judge in the border city of Brownsville, TX to declare DACA unlawful. They claim the program infuses the job market with workers who compete with Americans for ...work and burdens states with health-care and education costs. This is the same Federal Judge that had ruled against DACA in the past. The Judge is holding a hearing on December 22, 2020. Our advice is that if you are ready to proceed and have all your documents in order, consult with an attorney immediately and file your applications right away before the program is cancelled, yet again, with a new round of lawsuits. DACA UPDATE NEWS: In a complete rebuke for the United States Supreme Court Case, USCIS has issued a policy memorandum prohibiting new DACA applications to be submitted. Renewal applications will continue, but the validity time has been reduced from 2 years to one year. The filing fees will remain the same as of now and some advance parole applications will be allowed to process. Here is a link to the Policy Memorandum. ====...
