Legal News: According to accounts in San Diego and Santa Cruz, DMV has on occasion informed individuals who are lawfully present but without proper documents (e.g., those with pending extensions of stay or change of status and only an I-797C, etc.) that they cannot apply for an AB60 license in the interim while waiting for benefit approval. This is contrary to what Sacramento has been advising. Although it is not desirable for a lawfully present individual to have to apply f...or an AB 60 license in lieu of a full privilege license, until the issue is resolved, this is the only option available. The issue has been raised with DMV Sacramento and the agency confirmed that this should not be happening. Such instances are the result of a DMV official(s) at the local office(s). Individuals who are lawfully present but lacking proper documents under the CA regulations can apply for an AB60 license in the interim while waiting for their immigration benefit to be approved. DMV indicated that they will need specifics in order to correct this type of issue. Additionally, DMV suggests that clients who are incorrectly advised that they may not apply for an AB 60 license should request to speak with the supervisor on duty to attempt escalation at the time of occurrence.

DAPA and DACA were created by presidential executive order, rather than Congress, creating certain legal issues as to separation of powers, proper scope of executive orders, funding for actions created via executive order, etc. On February 17, 2015, DHS Secretary Jeh C. Johnson issued the following statement: I strongly disagree with Judge Hanen’s decision to temporarily enjoin imple...mentation of Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA) and expanded Deferred Action for Childhood Arrivals (DACA). The Department of Justice will appeal that temporary injunction; in the meantime, we recognize we must comply with it. Accordingly, the Department of Homeland Security will not begin accepting requests for the expansion of DACA tomorrow, February 18, as originally planned. Until further notice, we will also suspend the plan to accept requests for DAPA. See more

Given the large caseload and limited resources, the Asylum Division began prioritizing asylum applications for interview scheduling as follows: First, applications that were scheduled for an interview, but the applicant requested a new interview date; Second, applications filed by children; and Third, all other pending a...ffirmative asylum applications will be scheduled for interviews in the order they were received, with oldest cases scheduled first. Listed below are things the IRS will not do: 1) Call to demand immediate payment, nor will the agency call about taxes owed without first having mailed you a bill; 2) Demand that you pay taxes without giving you the opportunity to question or appeal the amount they say you owe; 3) Require you to use a specific payment method for your taxes, such as a prepaid debit card; 4) Ask for credit or debit card numbers over the phone; 5) Threaten to bring in local police or other law-enforcement groups to have you arrested for not paying; and 6) The IRS does not use e-mail, text messages or any social media to discuss your personal tax issue. If you get a phone call from someone claiming to be from the IRS and asking for money, here’s what you should do: If you know you owe taxes or think you might owe, call the IRS at 1.800.829.1040. The IRS workers can help you with a payment issue. If you know you don’t owe taxes or have no reason to believe that you do, report the incident to the Treasury Inspector General for Tax Administration (TIGTA) at 1.800.366.4484 or at www.tigta.gov.
