The IPAT Clinic has always made it a priority to take on projects that promote racial justice and strengthen civil rights and civil liberties in the digital age. But we must do more. We are now engaged in a comprehensive effort to ...rethink our work, and ask how we can center anti-racism in everything we do. As we engage in this urgent process, we are finalizing an IPAT Clinic project that is uniquely relevant to the struggle for racial justice. Since 2018, we have been working with Professor Charis E. Kubrin on the first-ever practice guide for defense attorneys who are fighting Rap on Trial, the deeply problematic use of rap lyrics in criminal trials. May the 4th has come to represent everything Star Wars, but for many it represents one of the worst episodes of the Vietnam era: the Kent State Massacre. For the past few years, it was our privilege to work with Dan Miller, Suzanne Clark, and the other amazing filmmakers who created Fire in the Heartland: The Kent State Story--the definitive documentary telling the entire Kent State story. In this Op-Ed by IPAT's own Professor Susan Seager and Sachli Balazadeh-Nayeri, they argue that the Hollywood sign is a public treasure and people should not be able to show it in their films and news pieces without fear of getting sued. Despite a dubious trademark registration for the word HOLLYWOOD, everyone still has the right to depict real landmarks and places (aka "descriptive fair use") and the right to free expression; many courts have affirmed First Amendment protection for expressive works. "The Hollywood sign is a historical, geographical and cultural touchstone for Los Angeles. It’s not just a billboard for Hollywood. A new Netflix docuseries, The Trials of Gabriel Fernandez, was made possible in part by the work of students in the University of California, Irvine School of Law's IPAT Clinic. The students have worked for more than a year to unseal court records for series co-producer Garrett Therolf, a staff writer at UC Berkeley’s Investigative Reporting Program. Therolf used the court records in the Netflix series to bring national attention to the repeated failure of the Los Angeles Cou...nty Department of Children and Family Services to protect chronically abused children from being killed by parents and caregivers. The law students won disclosure of confidential juvenile court records for two child abuse victims, Anthony Avalos and Noah Cuatro, whose deaths are investigated by Therolf in the final episode of the Netflix series. We are thinking of our dear friend Gordon Quinn who is in the hospital fighting COVID19. We've worked with Gordon, Kartemquin Films, and others for years in the fight to make sure filmmakers can make fair use. Gordon has been a visionary and a leader in so many ways, and the fight for fair use is just one of them. Today we send him and everyone fighting COVID19 our very, very best.
