How can tribes solve--or at least minimize--the confidentiality conundrum of consultation. Tribal NAGPRA officers do everything possible to affiliate Ancestor...s and sacred objects so the Ancestors can return home. But in the process, Tribes can feel the process required them to share highly sensitive information about ceremony and culture. Can institutions be trusted with this information? Who else could gain access to it? Who owns consultation information and usage? Today, we received guidance from Laura van Schilfgaarde (Cochiti Pueblo) and other Tribal leaders. Laura directs the UCLA School of Law's Tribal Legal Development Clinic. NAGPRA doesn’t explicitly protect confidentiality, explained the panelists from Preserving Confidentiality While Protecting Cultural Heritage. But Tribes are not without recourse. Laura’s law students developed a White Paper to guide us through this tricky topic: In going about the work of protecting cultural resources, tribes find themselves in a bind. The protection of one resource almost always requires the exchange for another. Sovereignty is the right to control the dissemination and use of tribal knowledge. In the coming weeks, we will share this panel’s sage advice. Here is just one of Laura’s recommendations: have institutions sign a Memorandum of Understanding that lays out the terms of how consultation information may be recorded and shared. The penalty for violating the MOU? Appearance before a Tribal judge and charges under Tribal law. Missed this panel?
