ACA is here to stay- The Supreme Court has dismissed the most recent challenge to the Affordable Care Act in a 7-2 decision and the ACA will remain in effect. This represents the third time SCOTUS has been asked to consider significant changes to the law. The challengers (18 GOP states led by Texas) urged the court to rule that the ACA's requirement for nearly all Americans to obtain health insurance or be subject to the individual mandate was unconstitutional and as such the... law should be eliminated. Justice Breyer said that the states did not have standing to challenge the individual mandate because they had not shown injury traceable to the enforcement of the provision they claimed to be unconstitutional. This also suggests that it will be difficult for any challengers to use this legal theory later on. Justice Breyer was joined in his decision by Justices Roberts, Thomas, Sotomayer, Kagan, Kavanaugh and Coney Barrett.
