Pretty common vortex situation in my practice. We got hired on a felony probation case where the client had been deported after transfer to the Feds from jail. ...This creates problems, because the client, as always, is ordered to report to probation, but cannot willfully do so in another country. After the "failure to report", the probation department will notify the court and calendar a probation violation. Without any advocacy, the court will issue a bench warrant (client fails to appear because he/she was deported). This warrant (and revocation of probation) creates an impending disaster vortex for the client when he/she returns to the US to their family: Often times, the client is re-arrested on this bench warrant and exposed to years in prison for the "violation." Even if the lawyer can prevent a probation violation, the damage is often already done --- the client, being in custody again, is transferred, again, to the Feds and gets deported, again. ****It's important for defense attorneys to be proactive and prophylactic to try and prevent these vortexes that can have disastrous consequences on clients and their families. So, today, before the court had an opportunity to revoke probation and issue a bench warrant, we proved that our client was deported from custody and that any failure to report was not willful and thus not grounds for a warrant, revocation of probation or any other violation. The case on point for this scenario is: People v. Galvan (2007) 155 Cal.App.4th 978. Court agreed and took no action, which simply means that probation will run its course and my client does not have to face another custody/deportation vortex when he returns home, to Los Angeles. #theleventhalfirm#criminaldefenseattorney#dontwaitadvocate See more

Often times, I have to litigate criminal protective orders with underlying family law disputes over child-custody. When there is no child custody order/agreemen...t in the underlying family court case, the criminal court will usually keep a full stay away order in place such that our client is precluded from seeing their kid(s). Very difficult to get the criminal court to modify the order allowing contact with the kid(s) when the prosecution objects (routine), and there is no family court order/agreement in place with respect to custody. Today, we managed to convince the criminal court to allow my client to see his kids over the prosecution's objection and without any family court order/agreement in place. This does not happen often, at least in my practice. And, this one is especially important because my client is 70 years old, fighting cancer, and hasn't seen his kids in a year after spending the last 12 years with them. G-d only knows what can happen tomorrow, especially during this Pandemic. Everyday is precious. We are very grateful for the court's compassion today. Good result today. Client on probation for DUI, picks up a second DUI with a BAC of .21. Both cases were in warrant status from a few years back. Got warrants c...leared up and kept my client out of jail with no action on the probation case, and a reduction to a reckless driving ("wet") on the open second DUI case --- no jail, just a 12 hour DUI class and community service. Indeed there were legal issues to litigate, but if we lost these issues, the prosecutor would be asking for a lot more jail. And, we did all of this without the client having to set foot in court.
