DACA - Proceed with Caution Recent federal court decisions have upheld the DACA program and forced the administration to accept new applications again. However, we should continue to advise our clients of the limitations of DACA and possible risks of applying. DACA, or Deferred Action for Childhood Arrivals, protects undocumented immigrants who came to the US before age 16 from deportation. Although DACA protects undocumented persons from deportation and provides work authori...zation, it doesn't give applicants a path to permanent residence or citizenship. Applying for DACA also gives the government a great deal of personal information, such as an applicant’s home address, criminal history, and education. We have no guarantee that this information won't be used to target undocumented applicants for deportation in the future. And under the current administration, the DACA program is obviously not a priority. Initial applications and renewals submitted today will most likely not be considered for several months. So while I'm preparing initial DACA applications for clients, I don’t plan to submit them until the new administration is in place in January. Last month, I had my client’s ankle monitor removed. She’s had it on since she entered the country last year. What should have been a simple process became almost impossible, because of the COVID shutdown. The local ICE office has been closed for months, and there was no way to reach anyone. After trying for weeks to get through to someone by email, I finally reached the right officer, who was able to help. I’m so happy for my client to get this done. We have a long road ahead pursuing her asylum case in immigration court, but removing the ankle monitor has already improved her outlook and given her some peace of mind.
