#WorkersCompWednesday Hablamos Español What is Workers’ Compensation?... As an employee, do you think about what would happen if you got injured on your job? What about your mortgage/rent? Doctors’ bills? Food? Childcare? If you have been injured, what do you do? California workers’ compensation laws are based on a system where certain employers carry insurance for accidents to employees, regardless of fault. California law states, [An] Industrially injured employee has a right to medical treatment . . . at the expense of the employer. What is a work-related injury? Work related injuries include slip and falls to more complex injuries, such as: stress and related conditions, irritable bowel syndrome, depression, body aches, headaches, high blood pressure, carpal tunnel, and even certain cancers. If you aren’t sure if your condition is related to your job you may need to see a doctor that handles workers’ compensation injuries. What happens when a claim is filed for a workers’ compensation injury? When you file a claim for workers’ compensation injuries you may be entitled to receive temporary disability payments, which is approximately two-thirds of your income, for a maximum of 104 (one-hundred and four) weeks. However, there are times when the employer may dispute the injury, maybe because there was no report of the injury when it happened. An injured employee may be entitled to obtain treatment from a doctor then seek assistance from the workers’ compensation court to order the employer to pay for these medical expenses. In California, the workers’ compensation laws have changed and once you believe that your aches or pains could be related to your job, you should immediately seek the assistance of an experienced workers’ compensation attorney. However, certain assets are exempt under Federal Law and are not liquidated in bankruptcy. These items can include: your home, clothing, cars, household goods, bank/savings accounts, electronics and 401K/pensions, (depending on the value/amount of the assets) just to name a few, to pay off your creditors in exchange for discharge of your unsecured debts. In Chapter 13, you pay off your debts, through monthly payments, of no more than 60 months. You may pay a fraction of your debt and monthly payments depend on many factors, including household income. Many clients ask how long it takes to rebuild your credit after a Bankruptcy. After your debts are discharged and your bankruptcy case closed, many creditors are aware that the debtor has additional income. Debtors are no longer paying the monthly payments for the accounts that were filed in the bankruptcy and creditors are willing to extend credit to a-newly-out-of-bankruptcy-individual. The scary part is that creditors also know that if you just got out of a bankruptcy, in many cases, Bankruptcy Laws prevent you from filing again for bankruptcy, for a certain period of time. So, if you default in credit acquired after bankruptcy, creditors can demand payment. However, after taking the mandatory credit counseling class that is required by people filing for bankruptcy, you will learn valuable tools that will help you rebuild your credit, easily and with a new outlook on credit!
