Statements you make to other people can be used against you in Court. Friends and Family who love and support you are curious and you may want to discuss the allegations with them, but it is to your advantage to only discuss the case with your attorney. If you are incarcerated, your visits from family and friends are recorded and can be used against you. Only your visits with your attorney are confidential and not recorded. You are free to discuss anything else with them and all you have to politely say is that you have been instructed by your attorney not to discuss the case with anyone. Famy Law Tip - Child Custody & Visitation modification: in order to modify a child custody order you have to show a "substantial change in circumstances" regarding the children that would justify the Court changing the current schedule. An example of this is that the children's grades have significantly declined as a result of the custody schedule. So document as much as possible. Maintain a calender or journal specifically for the children and the many issues that may ar...ise. Communicate those concerns in writing to the other parent and request a written response. This can be done via email or text message and save that communication should you need to provide it to the Court. Do your best to try to resolve any issues with the other parent. 1. Always remain calm and professional; never be rude or a smart-alec. This will not help you in any way and can only cause more problems. 2. Know your rights A. Right to remain silent; you DO NOT have to give them a statement, your words can/will be used against you. Your statement to the officer almost never comes out the way you said it in their report. It is always best to talk to an attorney before giving any statement. B. In limited circumstances they may have ...right to "pat" you down for weapons. But unless police have a search warrant they DO NOT have right to search your home, car or your person(body). DO NOT consent to any searches. Make it clear that you are NOT giving consent. When police tell you. "You don't mind if we search your car for weapons, right?", tell them "YES, I do mind, you can not search." C. You have the right to a lawyer before giving a statement. 3. If you are arrested/taken into custody, as soon as you have a chance write down in as much detail as possible about the circumstances leading to the arrest.
