The State Bar is accepting applications pursuant to new Rule of Court 9.49 (eff. November 17, 2020) Under Rule 9.49, a provisionally licensed lawyer would be allowed to provide a broad array of legal services for clients, including appearing before a court, drafting legal documents, contracts or transactional documents, and pleadings, engaging in negotiations and settlement discussions, and providing other legal advice, provided that the work is performed under the supervision of a qualifying supervising lawyer. NEWS FLASH: State Bar Court, Review Dept. Judge Richard A. Honn was re-appointed today to a second 6-year term by the Supreme Court of California. First, appointed to the State Bar Court Hearing Department in 2003, Judge Honn was elevated to the Review Department in 2014. I have appeared before Judge Honn since he was assigned to the Hearing Department and have appeared before him in the Review Department. Judge Honn is an experienced, thoughtful, and careful jurist and a credit to the State Bar Court. Congratulations on your re-appointment, Judge Honn.

HOPE THIS HELPS!!: Many of you have questions about the "rebate" funding recently enacted by President Trump: Here is a quick summary (Not legal advice only general info): :) Under the bill, all U.S. residents with adjusted gross income up to $75,000 ($150,000 for married couples), who are not a dependent of another taxpayer and have a work-eligible Social Security number, are eligible for a full $1,200 ($2,400 for married couples) rebate as well as an additional $500 per chi...ld. This rebate is allowed even for those who have no income, as well as those whose income comes entirely from non-taxable means-tested benefit programs, such as SSI benefits. For the majority of Americans, no action on their part will be required in order to receive a rebate check as the IRS will use taxpayers’ 2019 tax return, if filed, or in the alternative their 2018 return. The rebate amount is reduced by $5 for each $100 that a taxpayer’s income exceeds the phase-out threshold. The amount is completely phased-out for single filers with incomes exceeding $99,000, $146,500 for head of household filers with one child, and $198,000 for joint filers with no children.

Technical competence is a real consideration for attorneys. Although not mentioned in the California Rules of Professional Conduct, the ABA Model Rule 1.1, Comment 8 provides: "To maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks asso...ciated with relevant technology, engage in continuing study and education and comply with all continuing legal education requirements to which the lawyer is subject." It may seem to some attorneys that a thorough understanding of issues like stalkerware, big data, and data security and privacy laws and rules are subject areas beyond what our professional obligations require us to master. Don't be so sure. This is an issue that the ATILS task force has discussed in one of its 16 recommendations and the Board of Trustees consideration of the issue of technical competence is not as far-off a horizon as one may think.

Giving back, as the saying goes, is its own reward. For the past 5 years, I have been the "attorney coach" for the Armenian Mesrobian High School (and now Middle School) students preparing to compete in November's 42nd Annual Los Angeles County Mock Trial Competition sponsored by the Constitutional Rights Foundation. Yesterday, my students received a special guest lecturer, Tom Girardi. Mr. Girardi spent nearly an hour with my High School and Middle School students, talking a...bout how he got started in his legal career, some of his famous trials and even talked "shop" discussing cross-examination techniques and persuading the trier of fact. I commend the mock trial to any attorney who is interested in taking on the challenge of teaching trial work to High School and Middle School students. As the Scholarship recipient, I will serve as the CPR Diversity Initiative liaison and have been appointed as a liaison to the Center’s Diversity Committee, the Center’s Coordinating Council as well as to the ABA Standing Committee on Professionalism. Thank you Professor Rodriguez-Fee for extending the invitation. It was a fantastic experience! I presented about the State Bar Disciplinary system and offered practical advice to the students on the admissions process as well as other best practices for those areas of law practice that generate the most complaints to the State... Bar.
