Another example of AllState's despicable conduct. Their moto should really be: You are in good hands with AllState until you make a claim or need us the most. https://www.abajournal.com//federal-judge-sues-allstate-cl

Employers May Test Employees for COVID-19 Before Allowing Them Back to Work EEOC has announced that employers may administer COVID-19 testing to employees to determine if they have the virus, before allowing them to return to work. This latest guidance is consistent with the Americans with Disabilities Act which requires that any mandatory medical test of employees be job related and consistent with business necessity. EEOC has previously instructed employers to maintain CO...VID-19 employee health screening information and data confidential, as required under the ADA. If employers choose to administer COVID-19 testing to employees, they must ensure that any tests are accurate and reliable, suggesting that public health agency guidance, for example Food and Drug Administration guidance on what constitutes safe and accurate testing, should be reviewed. The EEOC also reminded employers that certain types of testing has the potential yield false positives or false negatives (accurate testing only reveals if the virus is currently present; a negative test does not mean the employee will not acquire the virus later). EEOC has noted that employers should to the greatest extent possible, continue to require that employees observe infection control practices (such as social distancing, regular hand-washing, and other measures) in the workplace to prevent transmission of COVID-19.

This Act goes into effect 15 days after the President’s signature, or April 3. The law covers employers with up to 500 employees, but employers with 50 or fewer may seek exceptions from the Department of Labor, and those with 25 or fewer are not obligated to reinstate an employee to their ...Continue reading

We love the end of the year!! It's an absolutely crazy time. However, it's also the time when clients whose cases we have resolved in this past year and sometimes in the several previous years reach out to say hello and express their love and appreciation for what we have done for them and their families. I am touched and honored by the outpouring of love from my current and former clients. Just today alone we received these three lovely packages from three separate clients. This makes me feel great about what we do.
